Protected Species
In addition to designated sites, there are other sites which are likely to contain protected plant and animal species. These species are primarily protected under the Conservation of Habitats and Species Regulations 2010, Wildlife and Countryside Act 1981 and other Acts which protect particular species, such as the Protection of Badgers Act 1992. The presence of a protected species is a material consideration when considering a development proposal, particularly if it is likely to result in harm to the species or its habitat.
Policy LP44 (PDF) [110KB] of the Gosport Borough Local Plan 2011-2029 is relevant with regard to protected species.
For more information and a list of species protected by these acts see Circular 06/05.
