Mandatory-Supply of alcohol
Licensing Act 2003 Section 19 - Supply of alcohol Where a premises licence authorises the supply of alcohol, the licence must include the following conditions: that no supply of alcohol may be made under the premises licence - (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Mandatory - Section 19A - Age Verification
Where the licence authorises supply of alcohol only for consumption OFF the premises. 1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. 2) The policy must require individuals who appear to the responsible person under the age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

Mandatory - Condition Permitted Price
Alcohol minimum permitted price - from 6 April 2014 - on and off sales/supply 1 A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2 For the purposes of the condition set out in paragraph 1 - (a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula - P = D + (D x V) where- (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence - (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) "valued added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3 Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4 (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

Crime - training
The premises licence holder shall ensure that a training package is in place in order for all staff involved with the sale, supply or delivery of alcohol to be sufficiently trained in licensing matters proportionate to their role and aware of their responsibilities, including challenge 25 and refusals. Particular attention should be paid to underage sales / ID verification and the refusal of alcohol sales to a drunk person. Records shall be kept of this training, dated and signed by the staff member and trainer. Refresher training shall be completed at least every 12 months again with documented records made and to be available for inspection by Police and other responsible authorities. A written record shall be retained at the premises to show the staff that have been authorised to sell alcohol. This shall be made available to the Police and other responsible authorities on request.

Crime - police delivery condition
The premises licence holder shall ensure that no alcohol shall be sold or delivered to a person who is drunk or disorderly or delivered to any premises where it is obvious that disorder or anti-social behaviour are occurring. No alcohol shall be sold as part of the 'delivery service' to any place that is not a recognisable dwelling or business address. The premises licence holder shall ensure that 'delivery service' orders that include alcohol shall only be delivered or handed to a person who is 18 years of age or over. Identification will need to be shown on occasions where C.25 applies to confirm the age of the recipient. Accepted forms of identification shall be passport, photo driving licence, or Proof of Age Standards Scheme (PASS) approved ID. Staff shall record the details of the type of identification where C.25 applies that is produced by persons receiving alcohol. The details of the identification, the linked order, the name of the staff member delivering, the date and time of delivery, method of payment and the address for the delivery of alcohol shall be retained and made available to produce to the Police or other responsible authorities upon request.. All records including any changes to the original order shall be retained for no less than 12 months

Crime - refusals and incident log
The premises licence holder shall ensure that a refusals book / incident book or log is maintained at the premises that will include any incident where underage or drunk customers are refused alcohol sales or deliveries and any other incidents of note that may occur. These records shall be retained for a minimum of 1 year and be made available to the Police and other responsible authorities upon request.

Crime - challenge 25
The premises licence holder shall ensure that a system is in place to ensure that every individual who appears to be under 25 years of age seeking to purchase or be supplied with alcohol at or from the premises, shall produce acceptable means of identification and age confirmation. Acceptable identification shall be a passport, photo driving licence or PASS accredited photo ID. If the person seeking alcohol is unable to produce acceptable means of identification, no sale or supply of alcohol will be made to or for that person

Crime - incident log
Any incident at the premises which impacts on the crime and disorder licensing objective shall be recorded in a register kept at the premises and shall contain the following information: a) time and date b) exact location c) nature of incident d) name of staff members or door supervisors involved e) name of any offender f) action taken as a result of the incident g) name of member of staff recording the incident This record must be retained at the premises for a period of not less than six months and be available on request by any authorised officer of the Licensing Authority or Police.

All payments for alcohol to be delivered shall be made by credit card only.

Crime - ID on delivery
Upon receipt of an order including alcohol to be delivered, the customer shall be clearly advised that the delivery will only be made to the person named on the credit card and that if they appear to be under the age of 25 they shall be required to produce an approved form of identification, the name of which corresponds with the name on the credit card. Failure to provide the requested identification and or credit card shall result in non-delivery of the alcohol and a refund in respect of that part of the order which relates to the alcohol only.

Crime - delivery note
For every delivery a customer will sign a delivery note which shall contain: i) Date & time ii) Name of person making order iii) Address of delivery iv) Details of ID provided if Challenge 25 policy applies v) Items delivered vi) Member of staff making delivery vii) Delivery notes shall be kept and made available for inspection by the Police or authorised officer from the Council for 6 months from the date of delivery.

Crime - Deliveries
Deliveries of alcohol shall only be made to residential dwellings or a place of work with a recognisable postcode. The delivery shall only take place only if the person receiving the alcohol is inside the property, or inside a communal doorway, and able to prove to the person delivering the alcohol they are a resident or employee at the premises. Alcohol shall not be delivered to a person who is in a public place e.g. in a street, a park etc. and no sales will take place directly from the delivery vehicle.

Safety - escape routes
All exit doors shall be available at all times when the premises is open to the public without the use of a key, code, card or similar. Exit doors shall be regularly checked to ensure they function satisfactorily. Safety checks shall be carried out before the admission of the public, and these should be recorded in a log book available on request to an authorised officer of the licensing authority.

Safety - capacity
The capacity of the store and premise shall be restricted to a maximum of 15 people. A suitable method of determining the number of persons on the premises at any one time shall be employed to ensure that the maximum permitted capacity is not exceeded. A notice shall be displayed prominently at the entrance to the premises indicating the maximum number of persons permitted on the premises (or any particular part of the premises) at any one time.

Nuisance - cleansing
The licensee shall ensure that the footway and public space in the vicinity of the premises is swept and kept free of litter at regular intervals whilst the premises are open and at the close of business, and litter and sweepings disposed of in an appropriate manner.

Nuisance - glass disposal
All refuse and bottles shall be disposed of in bins quietly so as not to disturb local residents. There shall be no disposal of glass bottles outside between 23:00 hours and 07:00 hours.

Nuisance - bins
An adequate number of waste receptacles for use by patrons shall be provided and emptied at appropriate intervals. The licensee shall ensure that all waste is properly presented and placed out for collection no earlier than 30 minutes before the scheduled collection times.

Notices shall be exhibited in prominent positions on the premises to ask patrons to dispose of their rubbish in the bins provided.

Children - age restrictions
Persons under the age of 18 shall only be admitted to the premises if they are supervised and accompanied by an adult whilst on the premises.

Children - management of premises
The management of these premises shall devise and implement a written policy for the provision of appropriately qualified and trained staff at the premises. In the absence of the designated premises supervisor, a personal licence holder shall be on the premises at all times when alcohol is available for sale. All staff responsible for alcohol sales shall be able to converse with members of the public and relevant agencies in English.

Children - training
All staff employed in the sale of alcohol shall be trained in respect of the law relating to the sale of alcohol, the company¿s proof of age policy and the procedure on handling and recording refusals. Training shall be documented in writing and details made available upon request by Thames Valley Police, Trading Standards Officers and Licensing Officers. Training shall be reviewed and updated on a regular basis.

Children - age verification policy
The licensee shall adopt and maintain a Challenge 25 Policy as part of their policy relating to alcohol sales. Clear signage relating to the policy shall be displayed at the premises.
