Licensing Act 2003 Section 19 - Supply of alcohol Where a premises licence authorises the supply of alcohol, the licence must include the following conditions: that no supply of alcohol may be made under the premises licence - (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Mandatory-Drinks Promotions
1.The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. 2. In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance or harm to children- (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to- (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b)provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on- (i) the outcome of a race, competition of other event or process, or (ii) the likelihood of anything occurring or not occurring; (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

Mandatory-No dispensing into mouth
The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability)

The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

Mandatory-Authorises supply of alcohol
(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark. (3) The responsible person shall ensure that- (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures- (i) beer or cider: ? pint; (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) still wine in a glass: 125 ml; and (b) customers are made aware of the availability of these measures.

Mandatory-Films
Films 1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section. (2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body. (3) Where- (a) the film classification body is not specified in the licence, or (b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority. (4) In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

Crime-general conditions 1
1. All Events on site to take place between 1st April and 31st October each year as agreed with Gosport Borough Council. Each Event will have to receive final approval from the Council's Chief Executive's Nominated Officer before it may go ahead. 2. The Event organiser must submit to the Safety Advisory Group a detailed Event Management Plan at least 90 days prior to the commencement of the Event. 3. The constituent bodies of the Council's Safety Advisory Group will determine what may be a reasonable time for their consideration of any information required to be supplied to them by the Event Organiser Any other time period imposed for consultation or submission of information may be waived only with the express permission of the Council's Chief Executive's, the Deputy Chief Executive or a member of the Council Management Team nominated by the Chief Executive should he or she consider it appropriate. 4. A contractual agreement to use the land does not exclude the Event Organiser from compliance with any of these license conditions. 5. An Event Management shall be produced in all cases and shall take account of the advice and requirements contained in "The Event Safety Guide" (HSG 195 - published by the Health and Safety Executive), "Temporary Demountable Structures: Guidance on procurement, design and use" (published by The Institution of Structural Engineers) and any other guidance including local guidance. 6. The Council's Chief Executive, the Deputy Chief Executive or a member of the Council Management Team nominated by the Chief Executive shall give final approval for the event to be held only if he or she is satisfied that all the conditions of the License are complied or will be complied with together with any other requirements to the satisfaction of the constituent bodies of the Council's Safety Advisory Group and that any additional terms or conditions relating to the hire or lease of the land have been met. If within 7 days of the planned opening of the event to the public, any of these conditions or requirements have not been met or are unlikely to be met the Council's Chief Executive, Deputy Chief Executive or a member of the Council's Management Team nominated by the Chief Executive shall make an informed decision to refuse approval of the event to be held on the premises. 1. The Event Management Plan is formulated to specifically address the issues surrounding Crime and Disorder. 2. Site security personnel where required will be provided in accordance with section 21 of the Licensing Act 2003. 3. The Event Organiser shall agree in writing with Hampshire Constabulary a Statement of Intent setting out their respective responsibilities for licensable activities no later than 28 days before the start of licensable activities, to include: a) the need for Special Police Services for the licensable activities, and b) the level/number of Special Police Services from Hampshire Constabulary if they are required, and c) Policing costs. No licensable activities shall take place unless suitable arrangements are in place to secure the provision of such numbers of police officers in agreement with the Police Area Commander. 4. No licensable activities shall take place unless the number of stewards and security personnel for the Event is agreed with the Event Organiser by the Police and the Licensing Authority no later than 7 days before the event is planned to open to the public. The number of appropriately trained stewards and SIA approved security personnel shall be provided for the main event area and for any ancillary or associated site including car parks, campsites, caravan sites and any similar facilities provided for the event in accordance with "The Event Safety Guide" (HSG195) published by HSE. 5. A schedule of stewards and security personnel shall be made available to the Licensing Authority no later than 2

7. All security staff and stewards shall be trained, briefed (in writing and verbally) and equipped to a standard that reflects their roles and responsibilities. Details of training shall be available on request to the Licensing Authority. The Event Management Plan is formulated to specifically address the issues surrounding Crime and Disorder. 8. No later than 28 days prior to planned opening of the event to the public of any event the Event Organiser shall submit to the Police full details of any CCTV system that is proposed (or if appropriate notice that no CCTV is to be used). Full details of the proposed system (including contractor, agreed positions, installation, operation, playback facilities and retention of data) shall be included. Any recordings shall be retained for a period of 30 days and be made available to the Police upon request. No licensable activity is to take place until written agreement of the proposed CCTV system (or agreement to the absence of CCTV) has been issued by the Police. 9. An interlocking 6ft "Heras" type perimeter fence shall be erected and maintained as a minimum, and patrolled by security personnel to ensure that unauthorised access cannot be gained. 10 Crime prevention advice shall be written in consultation with Hampshire Constabulary and displayed on signage around the site. 11 The Event Organiser shall prepare a drugs policy for licensable activities, to be submitted to the Police no less than 28 days prior to any licensable activity taking place and subject to written approval from the Police, which shall be based on three core messages: a) Prevention b) Drug dealers and users c) Welfare and treatment. Random searching shall take place at all entrances to the arena entrance for offensive weapons or drugs and alcohol along with other items that are not allowed onsite. 12. The seizure of any property shall be recorded and shall then be passed on to Hampshire Constabulary via security personnel for evidential purposes where appropriate. 13. Searching of persons shall be carried out by members of the same gender. The ticket shall indicate that searching will be carried out and there shall be signage with this message at all entrances. 14.There shall be a suitable receptacle for the safe retention of illegal substances at each entrance/exit and Hampshire Constabulary shall be informed of such arrangements so that appropriate disposal can be arranged. 15. No alcohol should be allowed to be taken into the arena area, no irresponsible drinks discounting shall be allowed at any event, in accordance with the British Beer and Pub Association guidance on responsible promotions. All sales of alcohol and other drinks to be provided in polycarbonate or similar non glass drinking vessels. All glass bottled drinks to be decanted at point of sale. All reasonable steps shall be taken to ensure that no glasses or bottles are allowed inside the arena. Bottle banks shall be located at the arena entrance to facilitate this rule. 16. There shall be mobile officers, in addition to the static points, to patrol any volatile areas and to react quickly to reports of incidents. 17. The sale of alcohol will continue only to artists and sponsors after the public bars have closed. 18. If, within 7 days of the planned opening of the event to the public, the Police are of the opinion that any of the conditions relating to public order are not complied with or will not be complied with they shall inform the Council's Chief Executive, Deputy Chief Executive or a member of the Council Management Team nominated by the Chief Executive in accordance with Part a) paragraph 6.

Safety-general conditions 1
1. Any event taking place on the site will be subject to an Event Management Plan encompassing Event Safety. The Event Management Plan must be submitted to the Gosport Borough Council Safety Advisory Group (SAG) no later than 90 days prior to the commencement of the event for their consideration. 2. An Event Advisory Group will be established for each event. The Event Management Plan will incorporate a full risk assessment of the event, in particular:- a) Independent safety checks shall be made to all temporary structures constructed on site and to perimeter security fencing and crush barriers by competent persons agreed by the Licensing Authority and the Council's Lead Officer for Health and Safety no more than 7 days before the planned opening of the event to the public. b) The provision of an adequate number of signed Emergency Exits will be identified in the Event Safety Plan and identified on the site plan which forms part of the Event Management Plan. c) First Aid provision will be provided on site subject to a risk assessment and identified in the Event Safety Plan d) A site evacuation procedure shall be prepared as part of the Event Management Plan for each event and all security staff, stewards and other event staff shall be fully briefed and made aware of its provisions. e) A comprehensive traffic management plan will be submitted as part of the Event Safety Plan encompassing traffic accessing, egressing and using the site. 3. For events promoted by Gosport Borough Council a Lead Officer will be designated, responsible for all aspects of compliance with the agreed Event Management Plan. 4. The Event Management Plan shall take account of "The Event Safety Guide" (HSG 195 - published by the Health and Safety Executive), "Temporary Demountable Structures: Guidance on procurement, design and use" (published by The Institution of Structural Engineers) and any other statutory and other guidance including local guidance which may be recommended by any documents relating to health and safety at public events that may be produced by the Hampshire and Isle of Wight Health and Safety Advisory Group. 5. For events promoted by a third party, the Event Organiser must be identified no later than 90 days prior to the commencement of the event. 6. The Event Organiser must carry a minimum of #10 million Public Liability Insurance which will indemnify Gosport Borough Council against all Public Liability Risks in connection with the use of the premises. 7. The Event Organiser shall notify the Licensing Authority and Safety Advisory Group (SAG) of any future event at least 90 days before the commencement of each event unless otherwise expressly agreed with the Licensing Authority and Safety Advisory Group. 8. The Event Organiser shall appoint a suitably qualified Event Safety Co-ordinator to the satisfaction of the Licensing Authority. The role of the Event Safety Co-ordinator shall consist of the following: i) Liaison with lead sub-contractors and any self-employed persons to be employed at the venue and ascertain their competence; ii) assistance in the inspection of the venue before and during licensable activities; iii) assistance in the inspection of all structures and electrical services; iv) checking and obtaining all relevant certification, safety policies etc.; v) advising of any unsafe work or inappropriate systems of work or unsafe equipment observed and, vi) assisting in the stopping of unsafe work or inappropriate systems of work or the use of unsafe equipment; vii) all public safety and security on the site; viii) responsible for all security matters This person shall have no other duties. 9. The Event Organiser shall arrange a meeting with the Safety Advisory Group and other appropriate bodies to discuss the measures that will be put into place to protect public safety and prevent public nuisance to enabl

10. Each specific Event Management Plan is to include details of the following: a) An event specific risk assessment shall be carried out to clearly identify the hazards which could cause harm arising from licensable activities and any associated activities such as site build-up and breakdown, car parking, camping, caravanning or any other activity which may take place in association with the event and controls shall be put in place and monitored to eliminate or lessen any risks throughout the event. b) The Event Organiser will ensure that a site plan(s) is submitted to the Licensing Authority and Safety Advisory Group, at least 90 days prior to the commencement of each event clearly indicating the position of the following: i)The site boundaries and entrances and exits to the site (including those for emergency services) which must be clearly labelled, ii) all roads and trackways (including emergency routes), car parks and other vehicle compounds, iii) to clearly indicate that there will be no camping on the licensed area save for commercial stall-holders with the express agreement of the Event Organiser, iv) the location of all structures, either constructed or brought onto the site, v) the location of all campsite(s), if appropriate, vi) the location of toilet, shower (if appropriate) and washing facilities, vii) drinking water points, viii) the location of all lighting facilities including those for the event arena, associated walkways and vehicle routes and emergency routes, ix) welfare tent and medical services, x) generators and other principle electrical connections, xi) fairground rides, xii) fire-fighting equipment and other associated fire-fighting provision. xiii) The storage location and means of storage and method of use of any liquefied petroleum gas (LPG), pyrotechnics or fireworks which may be used by any commercial traders, artists or event staff on the site. 11. The Event Organiser shall ensure that the latest edition of the event specific risk assessment is brought to the attention of all staff, contractors and stall holders, performers and other visitors to the event. 12. An adequate supply of free potable water shall be provided at locations throughout the event site and any campsite or caravan site and which shall be clearly and legibly marked and signed so as to be visible from all areas of the event site or camp site or caravan site. The number and locations of potable drinking water shall be agreed with the Licensing Authority and the Council's Lead Officer for Health and Safety no later than 7 days before the event is due to open to the public. All taps for potable drinking water shall be cleaned and sterilised at least daily during the event. SITE AND ENTRY AND EXITS 13. The Event Organiser shall ensure that a sufficient number of exit gates of sufficient width are provided dependent on the nature and size of licensable activities having regard to the "The Event Safety Guide" (HSG195) "Fire Risk Assessment - Open Air Events and Venues (ISBN 13 978 1 85112 823 5) and any other requirements of the Fire Safety Officer. 14. The Event Organiser shall ensure that all entrance and exit gates are maintained free from obstructions which may impede the prompt evacuation of the site and/or which may cause a person to slip, trip or fall. Where guy ropes, tent pegs, stakes and similar, flank entrance and exit routes they shall be in accordance with the Event Management Plan and Licensing Board Condition (where imposed). 15. Each gate in use shall be staffed by a suitably trained steward not less than 18 years of age or S.I.A. licensed operative (in line with HSG195 "The Event Safety Guide") at all times when the site is open to the public. 16. The Event Organiser, or nominated representative shall ensure that suitable and sufficient guarding is provided to the superstructure of tented structure

COMMUNICATIONS 19. An effective communications system shall be put in place to enable communication on site between the Event Organiser, Event Safety Coordinator, Licensing Authority, Emergency Services and other appropriate persons to ensure an effective and coordinated response to be implemented in the event of an emergency. Details of the communications system are to be provided to the Licensing Authority and the Council's Chief Executive's Nominated officer for his approval. LITTER CLEARANCE 20. Regular clearance of litter is to be undertaken during any event. If the event is to be organised by a third party the contract shall provide that each contractor on site shall have equal responsibility for such. 21. Adequate provision shall be made by the Event Organiser for the storage and disposal of food waste and other waste from the site and from associated sites used in conjunction with the event. OTHER 22. As part of the risk assessment for the event all entry and exit points shall be provided with suitable lighting during the hours of darkness to ensure safe access and egress to and from the site. Lighting will also be required at specific points and to enable patrons and event staff to move safely about the site at night. In particular there shall be an adequate number of lighting columns at each entrance and exit, at suitable points in any car park and coach park area, at suitable points along pedestrian access and exit routes to and from the site, at suitable points within the site to ensure the safety of the public, contractors, concession holders and event staff, at each block of temporary toilets to enable users to see once they are inside, inside any bar or beer tent area and at any other point that the Police, Fire Safety Officer, Gosport Borough Council or the Licensing Authority may require to ensure that any area within the boundary of the premises license that is being proposed for a planned event is safe and suitable.

Nuisance-general
1) All live music, recorded music and amplified music shall cease at 2300 hours. "Amplified music" shall include recorded music and radios, musical instruments through the use of an amplifier, amplified voices through the use of a microphone and amplifier or through a public address system. The term "amplified music" shall also include the playing of any acoustic instrument where its output is enhanced using any amplifier or microphone and amplifier. 2) Events are to be supervised by Stewards and SIA registered Security Staff. All security personnel will be provided in accordance with section 21 of the Licensing Act 2003. 3) (a) During the event, Music Noise Levels (MNL) shall be measured at regular intervals and shall not exceed 65dB LAEQ (15MIN) measured at 1 metre from the facade of the nearest affected noise-sensitive premises. (b) An electronic limiter or other equally effective dynamic method of feedback control to the levels emitted by the sound amplification system shall be fitted in order to comply with the Music Noise Levels required by 3(a) above of 65dB LAEQ (15 MIN) measured at 1 metre from the facade of the nearest occupied noise-sensitive premises. (c) A continuous level of 100dB LAEQ shall not be exceeded at the sound mixing desk. (d) The stage and public address system shall be facing away from the nearest noise-sensitive premises. (e) The loudspeakers for the sound system or public address system shall be positioned on each side of the stage and direct sound down into the audience area and away from the nearest noise-sensitive premises. (f) Prior to the commencement of the event, existing background noise levels at the nearest noise-sensitive premises will be assessed by Gosport Borough Council Environmental Health section. (g) The Sound Engineer for the event shall be instructed by the Event Organiser to obey any instruction from the Premises License Holder (Gosport Borough Council), The Event Organiser, the Police, Gosport Borough Environmental Health Services or the Licensing Authority. 4) Risk assessments will be undertaken for all events and as a result steps will be taken to avoid public nuisance being caused to residents in the immediate and surrounding areas. 5) The site is open between 1st April and 31st October in any calendar year. 6) Rehearsal sound checks are only permitted between 0900 and 1800 hours. 7) Where the event is planned to last for more than one day, event staff, trade stallholders and other personnel on site after the event has closed to the public shall not be permitted to play any amplified music, radios or amplified recorded music overnight. 8) Stewards and security staff shall be positioned at all exits at the conclusion of the event on each day to advise patrons to leave quietly to prevent disturbance. Suitably located signs which shall be clearly and legibly visible to those leaving the site and which shall be lit during the hours of darkness shall be placed at all the exits and in the car parks and along the exit route for both pedestrians and vehicles to remind patrons to leave the event quietly. 9) Security personnel shall be employed throughout the night when an event is to be held on consecutive days to regularly patrol the site including any car park, coach park or campsite area.

Children-general
1) The Event Management Plan must fully identify the potential of harm to children and identify the necessary monitoring activities and procedures to be put in place to address the issues identified. 2) The Event Organiser shall prominently display notices at bthe point of sale that "It is an offence to purchase or to attempt to purchase alcohol if you are under the age of 18; or to purchase or attempt to purchase alcohol on behalf of an individual aged under 18 - section 149 Licensing Act 2003". 3) Bar staff shall ask for proof of ID whenever the customer appears to be under 21 as recommended by the Challenge 21 Scheme. 4) Soft drinks and drinking water shall be available on site as an alternative to alcohol. 5) No person under 16 years of age shall be permitted on the premises unless accompanied by an adult. Any person having the responsibility for the welfare of children on site must be CRB checked and approved and the Event Management Plan should include a plan to deal with all such lost/found children. 6) A Designated Premises Supervisor to be present and on site at all times when alcohol is being supplied under the premises license.
