Licensing Act 2003 Section 19 - Supply of alcohol Where a premises licence authorises the supply of alcohol, the licence must include the following conditions: that no supply of alcohol may be made under the premises licence - (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Mandatory - Section 19A - Age Verification
Where the licence authorises supply of alcohol only for consumption OFF the premises. 1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. 2) The policy must require individuals who appear to the responsible person under the age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

Mandatory - Condition Permitted Price
Alcohol minimum permitted price - from 6 April 2014 - on and off sales/supply 1 A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2 For the purposes of the condition set out in paragraph 1 - (a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula - P = D + (D x V) where- (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence - (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) "valued added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3 Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4 (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

ANNEX 2 ? CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE General The application relates to the sale by retail of alcohol for consumption off the premises as part of the applicants business of a small licensed retail supermarket and convenience store providing food and groceries to the local community. The steps adopted to promote the Licensing objectives are detailed below. The Prevention of Crime and Disorder CCTV Recordable CCTV to a standard and format agreed by the Police as acceptable for evidential use if required. Must be capable of recording the outside and inside areas of the premises including entrance and exit and must be so sited as to obtain good quality facial images. All images must be retained for a minimum of 31 days. Images must be made available to Police/Council officials on request with the facility to provide copies on any Windows based format. A staff member from the venue who is conversant with the operation of the CCTV system must be on the premises at all times that the venue is open to the public. This staff member must immediately be able to show Police or Local Authority Officers relevant images stored and provide such evidence as and when required. This allows for a prompt and effective investigation into all criminal offences that may occur. ALCOHOL All alcohol to be sited in full unobstructed view of CCTV. DPS/PERSONAL LICENCE HOLDER Designated Premises Supervisor / Personal Licence Holder to have day to day control of the premises and be available within a reasonable time at the request of the Police and Local authorities. Where the Designated Premises Supervisor is not present a written and signed authority for the sale of alcohol is present on the premises. The written authority must be current, dated and available on request to Police and Authorised Officers of the Local Authority.

Safety-Fire
The Applicant has conducted a Fire Safety Risk Assessment. The premises are fitted with appropriate fire fighting equipment, emergency lighting and an appropriate means of raising the alarm in the event of a fire; and the Applicant has installed a Fire and Security Intruder Alarm system which is monitored by Watch Dog Fire & Security Limited.

Nuisance-anti social behaviour
The Applicant is committed to protecting the amenity of residences and businesses in the vicinity of the premises although this is not principally a residential area. The Applicant will keep records of people engaging in public nuisance and will discourage these by reporting instances to the appropriate authorities. The licence holder will take steps to reduce the risk of anti-social behaviour occurring on the premises and elsewhere after customers have departed.

Children-Challenge 21
1. The Licence Holder will adhere to the Challenge 21 protocol, seeking identification from everyone who appears to be under 21, to prove they are 18, prior to the sale of alcohol. All staff shall be trained on the Challenge 21 protocol not less than every three months. Acceptable identification shall be passport, photo driving licence or PASS accredited photo ID. If the person seeking alcohol is unable to produce acceptable means of identification, no sale or supply of alcohol will be made to or for that person. 2.. A Personal Licence Holder or suitably trained member of staff to be working on the premises at all times when alcohol is available for sale. 3. Staff training records to be kept, and be available to an officer of a responsible authority. 4. A refusals register to be used and available for inspection by an officer of a responsible authority. All refusals to be recorded including refusals to sell alcohol. The holder of the premises licence shall ensure that the refusals log is properly maintained and this shall involve, but is not limited to, nominating in writing a responsible person to check and sign it on a weekly basis. 5. 'Challenge 21' posters shall be displayed in prominent positions at the premises.
