Licensing Act 2003 Section 19 - Supply of alcohol Where a premises licence authorises the supply of alcohol, the licence must include the following conditions: that no supply of alcohol may be made under the premises licence - (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

NUISANCE1
Nuisance-Music permitted
The playing of recorded music in the premises is permitted 24 hours a day pursuant to section 182 of the Licensing Act 1964.
CHILDREN
Children-When permitted
No children will be permitted in the bar after 21.00 hours. However, children will be permitted in the Restaurant until 23.00
HEARING
Hearing-conditions attached
ANNEX 3 ? CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY Those conditions contained in the original application from the Applicant amended by the Applicant to provide as follows:- 1. During any events, involving live or amplified music (other than low level background music) all windows will be kept shut. External doors will be kept closed and a sign placed outside the bar entrance asking customers to use the main hotel entrance. The doors will not be secured open and are fitted with self-closers. 2. Speakers will not be placed outside at any time. 3. Noise from music and voices emanating from the premises between 2300 and 0900 will be inaudible at the boundary of the nearest residential premises. All doors and windows will be closed at 2300 to assist in achieving this. 4. Noise from music played in the bar area whether taped or live will not impose on dining customers in the restaurant or hotel guests in their bedrooms. The duty manager will ensure that other guests in the hotel are not disturbed by bar activities. 5. The Designated Premises Supervisor will receive and respond to any complaints made throughout the duration of all musical events. 6. The air conditioning system and the cooking extraction system will be switched off when not required. 7. The disposal of empty bottles into outside stowage?s will not take place between 2200 and 0900. 8. Waste collection will not take place between 1600 and 0900. 9. To minimise disturbances to local residents, staff are given appropriate instruction and training to encourage customers to leave the premises quietly and not to loiter in the vicinity of the premises. Notices to that effect are also placed at the exits of the hotel. 10. Fireworks and other pyrotechnics will not be used other than with the prior consent of the Licensing Authority. 11. No admittance to the Bar or Restaurant by non-residential customers after 23.00 on any day. 12. Local Taxi firms to be informed on the admittance times given above [thereby reducing the likelihood of wasted journeys from town late at night and any provocation that may be caused when admittance is refused]. 13. The provision of regulated entertainment will be subject to regular review with reference to potential noise nuisance. And the following conditions: * Noise from the Dining Room shall not exceed levels agreed with the Local Authority but shall in any case not exceed that permitted Under section 5 of the Noise Act 1996 i.e. 35 db. * Use of the premises garden shall stop at 23.00 each evening. * No amplified live or pre-recorded music shall be played in the dining room. * Live un-amplified background music shall be permitted in the dining room provided the provision of such music is ancillary to the primary purpose of the use of the room. Prevention of Public Nuisance Reason: To prevent Public Nuisance: The Hours for the sale of alcohol (M) in the Operating Schedule shall be amended to end at midnight on Mondays ? Thursdays and at 01.00am on Fridays and Saturdays. The Hours for regulated entertainment ? live music (E) and dancing (J) ? in the Operating Schedule shall be amended to end at 23.00 on Mondays to Saturdays.
