Following a successful investigation by Gosport Borough Council’s Enforcement Officers, local resident John Young was found guilty of fly-tipping and ordered to pay £563 at Fareham Magistrate Court.
In August last year Streetscene Enforcement Officers were called to an incident of fly-tipped green waste on land adjacent to Green Crescent Allotments. Following a comprehensive investigation the Officers working with local residents, identified the offender as John Young, a local resident.
Mr Young was interviewed under caution and the matter was prepared to be heard at Fareham Magistrates Court. Unfortunately he failed to attend the court and a warrant was issued for his arrest.
Mr Young was subsequently arrested on the 23 March by Hampshire Police. The case was immediately heard at Fareham Magistrates Court where Mr Young pleaded guilty to the charge of depositing a quantity of tree waste at land adjacent to Green Crescent Allotments, without having the necessary waste management licence.
He was given a £100 fine for the offence and ordered to pay £100 legal costs, enforcement, investigation and clean up costs to the sum of £463.65, bringing the total amount to £563.65.
“This is Gosport Borough Council’s first fly tipping prosecution and a great success for the Enforcement team,” said Stevyn Ricketts, Head of Streetscene. “This should send out a clear message to anyone who offends in this way that fly tipping is simply unacceptable and that anyone caught doing so will be prosecuted.”
Residents and businesses should always ensure that anyone offering to remove rubbish from their premises is a registered waste carrier. This ensures that waste is always disposed of in the correct manner. In fact all businesses should have a trade waste agreement in place to ensure this occurs.
