If you need to apply for Building Regulation approval there is a choice of approaches involving either:
- A Full Plans submission, or
- A Building Notice
Unfortunately the Building Notice is not available where the application is in respect of a shop, office, factory, hotel or boarding house.
Where are the Differences Between Full Plans and a Building Notice
A Full Plans application will be thoroughly checked by a Building Control Surveyor to ensure that your proposals comply with the Regulations, and you will be issued with AN APPROVAL NOTICE.
This gives you peace of mind, knowing that your Building work, when constructed, will be in compliance with the National Building Regulations.
Charges - For a Full Plans Application are paid in two stages. The plan charge is submitted with the application and the inspection charge is invoiced to you after works commence.
The Building Notice avoids the need to submit a full set of plans, and normally requires only the completion of a notice and the provision of a site location plan. However, there are disadvantages. No approval notice is issued with a Building Notice, nor will you have a set of plans, approved as a permanent record of the design. The charge submitted with a Building notice is equal to the Plan Charge added to the inspection charge.
The Building Notice is ideal for the smaller type building projects. If you are unsure of the route most suitable to you ask Gosport Building Control Services who will be pleased to advise you.
How to Obtain Full Plans Approval
1. You should have detailed plans prepared of your proposals. The plans should be drawn to a recognised scale and consist of a layout of the building and/or extension, elevations and cross-sections of sufficient detail to demon strate compliance with the Regulations.
Two copies of the plans should be submitted, together with a location plan and completed application forms which are available from Gosport Building Control Services.
It is advisable to contact an Architect or Surveyor to prepare your drawings, however, the Building Control Surveyors will be pleased to offer advice if you require it.
2. The submitted application should be accompanied by the appropriate charge, details of which will be provided with your application forms.
3. The Council must give you a decision within five weeks (or two months if you agree to extend the time period). However, Gosport Building Control Services deal with the majority of submitted Building Regulations applications within three weeks.
4. You may commence building works as soon as you have submitted a completed application. This will, of course, be at your own risk until such time as your application is approved. .
How to Submit a Building Notice
The Building Notice is submitted in duplicate and consists of completed application forms of and a site/location plan.
The Plan and inspection charge added together is payable at this stage
The Building Control Surveyor may still need to request detailed plans to clarify certain proposals.
You may commence building works as soon as you have submitted the Notice, subject to having obtained all other necessary approvals ie Planning permission.
Do my neighbours have the right to object to my proposal
There is no requirement in the Building Regulations to consult neighbours. However, if you intend to build on or affect a party wall, build on the boundary with a neighbouring property or excavate near a neighbouring building, you must find out whether the work will fall within '
The Party Wall etc Act 1996', an explainatory leaflet is available from Building Control.
What charges do I pay?
When making a full plans application the charges are divided into two stages. The first, the 'plan charge' is paid when plans are submitted. The second, the 'inspection charge' is payable following the first inspection by the Building Control Surveyor after works commence, when an invoice will be sent to the owner of the property.
For a Building Notice application one 'combined charge' is payable on submission of the notice. This charge is same as the plan and inspection charges paid for a Full Plans application.
When Building Work Commences
You will be supplied with a set of cards which you may submit at the appropriate stages of your building works. Alternatively, you may arrange inspections by telephoning Gosport Building Control.
Remember, Gosport Building Control can by arrangement offer an out of hours service..
You should always notify your Building Control Surveyor at the following stages:
Commencement of work.
- When foundation excavations are dug.
- After foundations have been concreted.
- When the hard core and damp proof course is laid.
- When drains are laid.
- After drainage trenches are backfilled and
- the drains are under air or water tests.
- When the building is occupied and /or
- complete.
The Building Control Surveyor will visit the site and examine the work as it progresses. If you or your builder have any problems please do not hesitate to discuss the matter with your Surveyor who will endeavour to be of assistance.
When we have completed all our inspections and are satisfied that the building works comply with the Regulations we will send you a CERTIFICATE OF COMPLIANCE WITH THE BUILDING REGULATIONS.
You can use this certificate to assist in the claiming of a mortgage extension or to demonstrate that your building is up to standard if you decide to sell it. We would recommend you ensure a completion certificate has been issued prior to finalising your account with your Builder.
