Food Premises Registration

 

What is registration?

 

Registration of premises used for a food business, including market stalls, delivery vehicles and other moveable structures, is required by law. It involves completing a very simple form which details the name, address, type of food business, the foods handled, the name of the proprietor, address of head office or registered office, number of people engaged in the food business and whether or not it is a seasonal business. It is an offence to give false or incomplete information.

 

Why register?

 

The Food Hygiene (England) Regulations 2006 require all food businesses which are based within the boundaries of Gosport Borough Council to be registered with it. The purpose of this registration is to provide information to the local authority (Gosport Borough Council) which is responsible for enforcing food safety law, about the type of food businesses within its area. This enables the Council to target  inspections and education programmes effectively.

The proprietor or owner of the food business has a legal obligation to register with and notify any changes to the Council.

The application form for registering your food business can be found at the end of this text. (This is a standard application form which can be used for all Local Authority areas).

 

Who needs to register?

Everyone who runs a food business establishment, or who provides food as part of their business, must register with their local council.

You must tell (or arrange for someone else to tell) the Council about any premises you use for storing, selling, distributing or preparing food.

Food premises include restaurants, hotels, cafés, shops, supermarkets, staff canteens, kitchens in offices, warehouses, guest houses, delivery vehicles, buffet cars on trains, market and other stalls, hot dog and ice cream vans, etc.

If you use vehicles for your food business or in connection with a permanent premises such as a shop or warehouse, you only need to tell the Council how many vehicles you have. You do not need to register each vehicle separately.

If you have one or more vehicles, but no permanent premises, you must tell the Council where those vehicles are normally kept.

 

When do I register?

 

Anyone starting a new food business must register with their local council at least 28 days before opening for business.

 

How do I register?

 

Complete the application form at the end of this page, sign it and send it to Gosport Borough Council, marked for the attention of Environmental Health Services.

 

Is there a charge?

 

There is no charge for registration and Councils cannot refuse to register premises.

 

Does it run out after a period of time?

 

Registration does not need to be renewed.

However, it is the responsibility of the proprietor to notify the Council of any changes in the detail originally provided.

If there is a change of ownership of the business the original registration details may not be known, so it is advisable for new owners to send a registration form to the Council 28 days before they want to start trading.

 

What happens to my information?

 

The Council is required by the Regulations to keep a register, open to inspection by the public, containing the name and address of the food premises concerned and the type of business operated there.

Apart from this, the remaining information onthe form is confidential. The information cannot be revealed to anyone except an authorised officer of an enforcement authority or to a police constable.

The public can ask to view this register at any time whilst the Council offices are open. A small fee may be charged for this.


Do I get a receipt of my registration?

 

Unless you specifically ask for a receipt, or letter of confirmation, Gosport Borough Council will not provide proof of receipt of the food Registration form, in order to keep the Council's administartion costs down.
