43. APOLOGY
An apology for inability to attend the meeting was submitted on behalf of Councillor Cully.
44. MINUTES
RESOLVED: That the Minutes of the meeting of the Regulatory Board held on 9 July 2002 be approved and signed by the Chairman as a true and correct record.

It was reported that, in accordance with Standing Order 3.5, a deputation had been received relating to planning applications K.15064/1 - 11 Ashburton Road, Gosport.
PART II
46. REVIEW OF HACKNEY CARRIAGE NUMBERS AT THE FALKLANDS GARDENS AND THE INCREASE IN FARE TARRIFF
A report was considered from the Director of Development and Environment (a copy of which is inserted in the Minute Book as Appendix "A") which informed members of waiting times collected at the Falklands Garden taxi rank between 01:45 and 02:40 on Saturday and Sunday mornings from 20 January 2001 to 7 July 2002.
In order to gauge demand during these times, CCTV footage had been used to estimate how many taxi's there were in this area early Saturday and Sunday mornings.
It was reported that in an effort to encourage hackney carriage drivers to work these hours the Licensing-Sub Committee on 5 October 2001 had confirmed an increased fare from a fare and a quarter to a fare and a half from midnight until 06:00 hours, to be reviewed after six months.
The Director of Development and Environment felt that the report showed an improvement in numbers, but also drew the Board's attention to the need for more research to be done.
RESOLVED: That:
(i) the Council continues to monitor waiting times for taxis at the Falklands Garden taxi rank; and
(ii) the increase in hackney carriage tariff of fare and one half between midnight and 06:00 hours be continued for a further 6 month trial period.
47. HISTORIC BUILDING GRANT: BRODRICK MEMORIAL HALL, CLAYHALL ROAD, GOSPORT
Consideration was given to a report from the Director of Development and Environment (a copy of which is inserted in the Minute Book as Appendix "B") which advised the Board about a proposed offer of grant aid under Section 57 of the Planning (Listed Buildings and Conservation Areas) Act 1990 to Brodrick Memorial Hall, Clayhall Road, Gosport.
Members were informed that Brodrick Memorial Hall was built in 1908 and was prominently located in the Anglesey Conservation Area. It combined many interesting architectural design features from the use of terracotta as a decorative feature to semi-circular windows between the buttresses on the side walls and the ornate single storey façade to Clayhall Road, which incorporated the building's name.
The proposed works involved:
· Re-asphalting the flat roof to the single storey block to the front of the building. This area of the building had been suffering from water penetration in recent times.
· Re-pointing the front elevation above the flat roof.
· Making good the deteriorating terracotta features on the front elevation.
Members were informed that as Broderick Memorial Hall was not a listed building, a grant could be made of up to 15% of the overall repair works. The lowest repair works quote was £7,356.80, a 15% grant would therefore total £1,103.52.
RESOLVED: That a grant of £1,103.52 (or 15% of the total cost of works, whichever is the lesser sum) be offered towards the repairs to Brodrick Memorial Hall.
48. APPLICATIONS FOR PLANNING CONSENT
The Director of Development and Environment submitted a report on applications received for planning consent setting out the recommendations in each case.
RESOLVED: That decisions be taken on each application for planning consent as detailed below and as set out in Appendix "C" hereto.
49. K.15064/1 - ERECTION OF DETACHED DWELLING HOUSE (CONSERVATION AREA) - LAND ADJACENT TO 11 ASHBURTON ROAD, GOSPORT
[Councillor Hayward declared an interest in this item and left the meeting prior to its consideration.]
Consideration was given to planning application K.15064/1 relating to the erection of a detached dwelling house on land adjacent to 11 Ashburton Road, Gosport, which was located in a Conservation Area.
Following Public Advertisement, it was reported that 4 letters of objection had been received to the original scheme and 12 letters of objection in respect of the amended scheme. The objections related to -
· The property was too large for the plot in terms of width and height.
· It would not enhance or preserve the character of the Conservation Area.
· Indicative street scene plans did not show adjoining windows.
· Building should be moved further forward.
· Overlooking of adjoining properties and associated loss of privacy
· Loss of light.
· Loss of trees.
· Incompatible in design terms with 2 storey properties on that side of the road.
· The property did not have a garage which would encourage on street parking.
· Views to the property should be screened from 17 Ashburton Road.
· No access should be allowed from the rear, seaward boundary.
· Approval would make it difficult to refuse future proposals for light flatted development in the area.
Members were informed that the scale of the building was not out of keeping with other properties in the road and was appropriate in terms of design. The Conservation Officer had raised no objection to the proposal in terms of the scale or design. The proposal included five windows which would be secondary obscure glazed. Provision had been made for three parking spaces and, insofar as the rear access was concerned, the land was privately owned and therefore it would be impossible to gain access from the rear.
In accordance with Standing Order 3.5, Dr D Wright of Ashburton Road, Gosport, was permitted to address the Board on behalf of the local residents who had objected to the proposal. Dr D Wright made the following points -
· The structure was inappropriate in the area.
· The Local Plan indicated that a new dwelling should be appropriate to a location, similar in scale and height to reflect the dimensions of neighbouring houses - they felt none of these were satisfied.
· It was 40% higher than neighbouring properties, and 7m longer at the rear, dominating the back of next door properties, which resulted in the removal of any privacy.
· The property was set 4m further back from 11 Ashburton Road. The car parking space would not be lost if brought forward.
· The residual walkway around the house would be of a height to view next door's property and therefore invade their privacy.
· It would have a detrimental effect on the adjacent properties and generally made a mockery of the Local Plan.
In accordance with Standing Order 3.5, Mr Merritt, the applicant's architect, was permitted to respond to the comments made by Dr D Wright and he stated -
· that he supported the view of the Planning Officer. He felt the design was an innovative design in keeping with the area.
· he had attempted to blend old and new in his design, and felt that this had been achieved.
· It was a substantial house for a substantial site.
Members questioned the height of the ramp around the property and were informed that this was for disabled access. Mr Merritt saw no reason why the ramp could not be lowered. Mr Merritt also pointed out, when questioned on the height of the building, that due to the unpredictable nature of excavating the site for the foundations of the house, it would not be possible to accurately predict how high the property would be, but that it would be no more than 10.75m high.
An Amendment was proposed to refuse the application on the grounds that it contravened policies BE1 and BE9 of the Local Plan as well as the appendices referred to. It was felt that it was not appropriate in terms of form, scale, height, the conservation area would not be enhanced and it would not compliment the existing buildings. The Amendment was accordingly put to the vote and declared carried. Whereupon it was
RESOLVED: That the application be refused on the grounds that:
(i) The proposed development by reason of its design and location would neither preserve nor enhance the character or appearance of the Anglesey Conservation Area contrary to Policies BE1 and BE9 of the Gosport Local Plan; and
(ii) The proposed development by reason of its excessive building mass and location is not compatible with adjoining development in Ashburton Road and therefore would be detrimental to the visual amenities of the locality and be prejudicial to the amenities of adjoining residents contrary to Policy BE1 of the Gosport Borough Local Plan.
50. K.15168/1 ERECTION OF TWO STOREY REAR EXTENSION WITH FIRST FLOOR CONSERVATORY, 46 FAREHAM ROAD, GOSPORT

Consideration was given to planning application K.15168/1 related to the erection of a two storey rear extension with first floor conservatory at 46 Fareham Road, Gosport.
RESOLVED: That planning application K.15168/1 related to the erection of a two storey rear extension with first floor conservatory at 46 Fareham Road, Gosport, be refused following the recommendations set out in the report of the Director of Development and Environment.
51. K.12345/68 CHANGE OF USE AND SUB-DIVISION OF EXISTING PLANNING UNIT INTO MULTIPLE UNDEFINED PLANNING UNITS FOR INDUSTRIAL AND STORAGE/DISTRIBUTION USES, 154 FAREHAM ROAD, GOSPORT
Consideration was given to planning application K.123456/68 for change of use and sub-division of existing planning unit into multiple undefined planning units for industrial and storage/distribution uses, 154 Fareham Road, Gosport.

52. K.16096 GPD PART 24 CONSULTATION - ERECTION OF 15m. HIGH SLIMLINE MONOPOLE TELECOMMUNICATIONS MAST WITH ANTENNA ARRAY AND EQUIPMENT CABINETS, LAND AT JUNCTION OF ROWNER ROAD, FAREHAM ROAD, GOSPORT
Consideration was given to planning application K.16096 GPD part 24 consultation - erection of 15m. high slimline monopole telecommunications mast with antenna array and equipment cabinets, land at junction of Rowner Road, Fareham Road, Gosport.

Consideration was given to planning application K.16097 erection of 20m. high column telecommunications mast antenna array and equipment cabinets, Heritage Business Park, Heritage Way, Gosport. One letter of objection had been received regarding the siting of the proposed mast.

54. K.15999 DETAILS PURSUANT TO K.15500 - CONSTRUCTION OF MARINA TOGETHER WITH REPAIR AND STRENGTHENING OF QUAY WALL, ROYAL CLARENCE YARD, WEEVIL LANE, GOSPORT
Consideration was given to planning application K.15999 details pursuant to K.15500 - construction of marina together with repair and strengthening of Quay Wall, Royal Clarence Yard, Weevil Lane, Gosport.
Following Public Advertisement, it was reported that 1 letter of objection had been received to the scheme. The objection related to -
· Concern that the dredging will cause instability to quay wall.
· Uncertainty over where the dredged material will be deposited.
· All ecological mitigation measures must be implemented.
· Conditions in Management Statement should be reflected in planning conditions.
Members were informed that the above objections were not relevant to the planning application, but could assure themselves that all the correct procedures were carried out.

Consideration was given to planning application K.14624/9 change of use of amenity land to extend rear gardens and erection of boundary fences, 32-28 Williams Close, Gosport.
Following Public Advertisement, it was reported that 2 letters of objection had been received to the scheme. The objections related to -
· Loss of peace and quiet.
· Loud music - night and day.
Members were informed that the above objections were not relevant to the planning application.

Consideration was given to planning application K.14390/6 restoration of boundary wall and erection of railings and gates, St Marys Church, Green Road, Gosport.
Following Public Advertisement, it was reported that 26 letters of objection had been received to the scheme and 32 letters of support. The objections related to -
· Fencing in will give poor signals to worshippers i.e. 'keep out.'
· Proposed style inappropriate.
· The works are unnecessary, money could be spent on restoring the tombs and churchyard in general.
· Railings will result in detrimental impact on views of the churchyard and church.
· Historically railings were in place for a relatively short period of time.
· Railings will enhance the appearance of the Church and it's setting.
Members were advised that the railings were historically appropriate and the final design reflected the original form of railing.

Following Public Advertisement 1 letter of objection had been received. The objections related to -
· Planning conditions should control the uses on site.
· The Weevil Lane elevation is particularly prominent and must be retained intact.
Members were informed that mixed use of the site was in keeping with the development plans, and that the changes proposed were sympathetic to the status of the Listed Buildings.

Consideration was given to planning application K.13599/1 erection of two storey rear extension, 25 Moat Drive, Gosport.
Following Public Advertisement 3 letters of objection had been received. The objections related to -
· Loss of light to adjoining windows and conservatory.
· Guttering overhanging adjoining properties - consent would not be granted for this trespass.
· Over development out of character with similar properties in the area.
· Possible structural impact on adjoining property due to ground conditions.
· Possible flooding from roof drainage.
· The rear extension would bring the property too close to Gale Moor Avenue properties, which would result in loss of privacy.
· Could set a precedent.
Members were informed that the planning application was contrary to Local Plan guidelines and would be detrimental to adjoining properties and the character of the area.

Consideration was given to planning application K.16086 erection of two storey rear extension and car port, Monckton Cottage, Ellachie Mews, Ellachie Road, Gosport.
Following Public Advertisement 1 letter of objection had been received. The objection related to -
· Parking and turning, in the interest of highway safety.
· Drawing inaccuracies.
· The outlook from the proposal and sunlight to the proposal.
· Need to remove trees.
· Previous work at property i.e. / removal of buildings, construction of conservatory, removal of turning head.
· Traffic and parking problems when work in progress.
· No pedestrian access to property.
· Possible fires in proposed car port close to St. Peter's boundary.
Members were informed that the objections were not relevant to the planning application.

68. K.16060 ERECTION OF SINGLE STOREY REAR EXTENSION/CONSERVATORY, DETACHED GARAGE AND BOUNDARY WALLS, 30 CAMBRIDGE ROAD, LEE-ON-THE-SOLENT
Consideration was given to planning application K.16060 erection of single storey rear extension/conservatory, detached garage and boundary walls, 30 Cambridge Road, Lee-on-the-Solent.
Following public advertisement of the scheme one letter of objection had been received. The letter related to the following issues -
· The plans do not show an extension at 28 Cambridge Road.
· Loss of light to rear window of the adjoining property.
· Detrimental effect on property value.
Members were informed that the first point was not relevant to the planning application. The second point was also not relevant as the proposed structure would only be 0.4m higher than the current fence. The officer concluded that she felt the plans to be an improvement to the property and the area.
In accordance with Standing Order 3.7, Councillor Carter, as Ward Councillor, was permitted to address the Board. Councillor Carter stated that -
· he was speaking on behalf of Mr Russell at 28 Cambridge Road who had objected to the application.
· the extension referred to at 28 Cambridge Road was a "granny annex" for Mr Russell's mother.
· the proposed 2m high boundary wall, with a total apex of 3.4m, would cause a loss of light to the pathway along side the "granny annex", therefore it created a safety issue.
· a site visit be held before the Board made a decision on the application.
Miss Jacques, the applicant, was permitted to respond to the comments made by Councillor Carter and stated -
· the neighbours from 32 Cambridge Road had written a letter to her which stated they approved of the plans and were happy with them.
· her plan would create a more pleasant atmosphere to replace the current "eyesore".
· her plan had always been to extend the property, something the objector had known and approved of, as he had done plumbing work for her in the past for the base of the extension.
· the extension was in keeping with her house.
· the current buildings in her garden created a more serious health and safety issue.
Members voted against a site visit and in the subsequent vote to grant permission for the application Councillors Hayward and Langdon in accordance with Standing Order 6.7.13, wished their abstentions to be recorded in the minutes.
RESOLVED: That planning application K.16060 erection of single storey rear extension/conservatory, detached garage and boundary walls, 30 Cambridge Road, Lee-on-the-Solent, be approved subject to the conditions set out in the report of the Director of Development and Environment.

Consideration was given to planning application K.16058 erection of two storey side extension, 151 Skipper Way, Lee-on-the-Solent.
Following Public Advertisement 1 letter of observation had been received. The observations related to:
· Require written confirmation that any damage to adjoining garage be repaired and drainage redirected at applicants expense.
· Any damage to driveway to be repaired.

71. K.15396/2 OUTLINE APPLICATION - ERECTION OF DETACHED DWELLING WITH DOUBLE GARAGE, LAND ADJOINING 2 DOLPHIN HOUSE, GREEN LANE, ALVERSTOKE, GOSPORT

Consideration was given to planning application K.15396/2 outline application - erection of detached dwelling with double garage, land adjoining 2 Dolphin House, Green Lane, Alverstoke, Gosport.
Following Public Advertisement 4 letters of objection had been received. The objections related to:
· Ground available as a soakaway will be lost resulting in increased flooding problems in the area.
· Soakaways should comply with the Building Regulations 2000.
· The loss of trees will reduce the capacity to remove water from the ground and reduce wildlife habitats.
· Site notice was posted too far away from the application site in Foster Road.
· Positioning of the dwelling could impact on trees located at 13 Beech Grove.
· Dwellings should be restricted to single storey - so that it does not intrude on the peaceful enjoyment of 13 Beech Grove.
Members were informed that it was the principle for planning and not the actual plans that were up for approval. Following this, the objections were not relevant to the outline planning application.

72. K.1870/6 CHANGE OF USE FROM DWELLING TO DWELLING AND NURSERY SCHOOL, 142 PORTSMOUTH ROAD, LEE-ON-THE-SOLENT
Consideration was given to planning application K.1870/6 change of use from dwelling to dwelling and nursery school, 142 Portsmouth Road, Lee-on-the-Solent.
Following Public Advertisement 5 letters of objection had been received. The objections related to:
· Does the 18 include any family members of the proprietor or staff?
· Details of days of operation are not provided.
· Likely noise impact on adjoining residents.
· Vehicular movements to the premises - Portsmouth Rd/Marine Parade East/South Place is a busy and dangerous junction.
· Parking in the area/measures should be taken to slow vehicles down.
· If permission is granted it should be a temporary one for no more than 6 months so any problems can be reviewed.
· Little demand for such a facility from the immediate area, perhaps facilities like this should be considered for the new larger developments locally.
Members were informed that the granting of the nursery would only be for week days from 8am to 6pm excluding bank holidays. It was recommended that the issues of noise and parking be addressed by the granting of a one year temporary permission to enable officers to monitor activity at the property. The remaining objections were not relevant.

73. K.966/2 ERECTION OF FIRST FLOOR REAR EXTENSION AND SINGLE STOREY SIDE EXTENSION, 10 VECTIS ROAD, GOSPORT
Consideration was given to planning application K.966/2 erection of first floor rear extension and single storey side extension, 10 Vectis Road, Gosport.
Following Public Advertisement 1 letter of objection had been received. The objections related to:
· Details of the relationship to dwellings in Western Way are not shown within the application..
· Buildings are closely spaced in the area.
· First floor extension will dominate and overlook surrounding properties.
· Believe in building line at front of property - are there restrictions to the rear?
· Occupants of 12 Vectis Road are going to move - future occupiers may be seriously affected.
· No objection to the side garage extension.
Members were informed that the extension would not dominate the dwelling behind any more than the current building. Therefore the objections were not relevant to the planning application.
RESOLVED: That planning application K.966/2 erection of first floor rear extension and single storey side extension, 10 Vectis Road, Gosport, be approved subject to the conditions set out in the report of the Director of Development and Environment.
74. FEEDBACK ON PLANNING APPLICATION APPEALS
(Note: This item was not included on the Agenda for the meeting; however, in view of the need to keep Members of the Board updated on Planning Appeals, the Chairman agreed to consider the matter as an urgent item.)
The Chairman informed Members that in future he would be asking the officers to bring updates on proceedings at appeals. The Director of Development and Environment accordingly updated Members of the Board on 5 recent appeals.
