[It was reported that, in accordance with Standing Orders, Councillor P. Russell had been nominated to replace Councillor Train for the meeting.]
142. APOLOGIES
An apology for inability to attend the meeting was submitted on behalf of Councillors Cully and Smith.
143. MINUTES
RESOLVED: That the Minutes of the meeting of the Regulatory Board held on 5 November 2002 be approved and signed by the Chairman as a true and correct record.
144. DEPUTATIONS
It was reported that deputations had been received relating to planning applications K.16075 - 22 Marine Parade East, Lee-on-the-Solent, K.15064/2 11 Ashburton Road, Gosport and K.5353/14 Court Barn, Lee-on-the-Solent.
145. GOSPORT BOROUGH LOCAL PLAN: REVIEW - FORMAL DEPOSIT OF PLAN
Consideration was given to a report of the Director of Development and Environment (attached in the Minute Book as Appendix "A"). Members were informed that the Deposit Gosport Borough Local Plan Review had been published on the day of the meeting and Members were also made aware of the implications for future decisions related to the control of development.
At present the 1995 Gosport Borough Council Local Plan remained the adopted Local Plan but in making decisions on planning applications the First Deposit Local Plan Review was a material consideration. The weight to be given to the emerging Local Plan would increase as it progressed through the statutory process.
In reports to future meetings of the Regulatory Board officers would frequently refer to the policies of both the adopted 1995 Local Plan and the 2002 Local Plan Review which would in due course supersede it. In considering planning applications Members would need to have regard to both documents.
RESOLVED: That the report regarding the first Deposit Local Plan Review be noted and that, as agreed by the Policy and Organisation Board at its meeting on 18.09.02, the Plan Review be used for development control purposes following its publication on 11 December 2002.
146. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "B").
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
147. K.16075 - ERECTION OF A 4.5 STOREY BLOCK OF 11no. FLATS AND ASSOCIATED CAR PARKING (INCLUDING 1 BEACH ROAD) (as amended by letters dated 04.09.02 and 10.10.02 and by plans received 11.10.02 and amplified by letter dated 17.10.02 and plan received 21.11.02)

RESOLVED: That planning application K.16075 - 22 Marine Parade East, Lee-on-the-Solent be deferred until January 2003 to allow time for shadow drawings to be compiled.
148. K.15064/2 - ERECTION OF DETACHED DWELLING HOUSE (as amplified by letters dated 03.09.02 and 06.11.02) (CONSERVATION AREA)

[Councillor Hayward declared an interest in this item and left the meeting prior to its consideration.]
Dr Wright was permitted to address the Board on behalf of the objectors. Dr Wright made the following points:
· That the planning application had not changed significantly from the previous planning application (K.15064/1);
· That all the original objections regarding the Gosport Borough Local Plan were still relevant;
· The buildings on Monckton Road proved it was possible to build houses sympathetically with their surroundings;
· That the number of objectors had risen from 11 to 18;
· Although the design was attractive, it was not right and did not fit in with the rest of Ashburton Road;
· That the building contravened the Land Charges Register as it was less than 4 feet from its neighbours;
· The plans and building did not preserve or enhance the area.
Mr Merrett was permitted to address the Board on behalf of the applicant. Mr Merrett made the following points:
· That he had spoken with and complied with the demands of the planning department all the way along, a period of two and a half years;
· That the original objections to height and location and the rear ramp had been altered satisfactorily;
· That the Land Charges Register was void as it was for a former neighbour and that it was not a planning matter in any case.
Members were concerned that the Council should follow its own Gosport Borough Local Plan but were assured that this building was not in conflict with the principles of good design and that it reflected the street scene in an appropriate and modern way.
RESOLVED: That planning application K.15064/2 - Land Adjacent to 11 Ashburton Road, Gosport be approved, subject to the conditions set out in the report of the Regulatory Services Manager.

156. K.5353/14 - LISTED BUILDING APPLICATION - INTERNAL ALTERATIONS TO FORM OPENING IN WALL
COURT BARN, COURT BARN LANE, LEE-ON-THE-SOLENT
[Councillors Hayward and Taylor declared an interest in this item and left the meeting prior to its consideration.]
Mr Grady was permitted to address the Board as the sole objector. Mr Grady made the following points:
· The wall dated from the 17th Century and was the original outside wall of the house;
· That such history, especially in Lee-on-the-Solent, was rare and should be looked after, not destroyed;
· The reasons for knocking down the wall (more space, better lighting, improved views) were only be marginally improved, and were not needed at all;
· That there was no urgent reason to destroy the wall, Court Barn had to prove it was essential, which they had not done;
· The real reason for its destruction was the Club felt obliged to spend the grant supplied by the Brewery.
Councillor Burgess was permitted to address the Board on behalf of the applicant. Councillor Burgess made the following points:
· The removal of a section of wall was part of a range of items designed to improve the club;
· These plans had been outlined before the grant had been made;
· The walls were clad the same as the others so the visual impact was minimal;
· That the Council Officers had been consulted throughout.
Members questioned the need for the removal of the wall and were informed that this was not a relevant planning concern. Members were informed that the Conservation Officer had been consulted and was content to allow the work to proceed.
RESOLVED: That the Listed Building Application K.5353/14 - Court Barn, Court Barn Lane, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager.
157. K.7960/3 - REGULATION 3 - REMOVAL OF AGE RESTRICTION ON OCCUPANCY CONDITION (CONDITION 3 - K.7960/2)

Members were informed that one letter of observation had been received. It raised issues regarding a contingency plan for additional control of the pedestrian routes. Members were informed that the letter and the issues raised had been passed to the relevant Council department.

163. APPLICATION FOR THE RENEWAL OF A PUBLIC ENTERTAINMENT LICENCE FOR THE WHITE HART PUBLIC HOUSE
A report was received from the Regulatory Services Manager advising the Board of an application for a Public Entertainment Licence for The White Hart public house (a copy of which is affixed in the Minute book as Appendix "C").
Members were informed that letters of objection had been received on the afternoon of the day of the meeting. It was also reported that new management was due to be take up office shortly. It was suggested that the consideration of the application be deferred for two months to allow the applicant time to prepare a response to the objections raised, and to give the new manager time to address the concerns raised in the report.
RESOLVED: That the application for the renewal of a Public Entertainment Licence be deferred for two months.
164. EXCLUSION OF PRESS AND PUBLIC
RESOLVED: That under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in Paragraphs 4, 7 and 8 of Part 1 of Schedule 12(A) of the Act.
165. HISTORIC BUILDING GRANT: ST VINCENT HOUSE, FORTON ROAD

Consideration was given to a report from the Director of Development and Environment (a copy of which is inserted in the Minute Book as Appendix "D") which advised the Board about a proposed offer of grant aid under Section 57 of the Planning (Listed Buildings and Conservation Areas) Act 1990 to St Vincent House, Forton Road, Gosport.
RESOLVED: That a grant of £2,249.25 (or 15% of the total cost of works, whichever is the lesser sum) be offered towards the repairs to St Vincent House.
166. REVIEW OF AN INDIVIDUALS HACKNEY CARRIAGE AND PRIVATE HIRE VEHICLE DRIVER'S LICENCES FOLLOWING A RECENT, RELEVANT CONVICTION
Consideration was given to an exempt report of the Regulatory Services Manager (a copy of which is inserted in the Minute Book as Appendix "E") in connection with the review of the Hackney Carriage and Private Hire Vehicle Driver's Licences granted to a specific individual Licence Holder.
RESOLVED: That the review of the individuals Hackney Carriage and Private Hire Vehicle Driver's Licences be adjourned for two months on conditions.
