RESOLVED:  That the Minutes of the Regulatory Board meeting held on 13 December 2005 be approved and signed by the Chairman as a true and correct record.

It was reported that a deputation had been received on Circular 18/84 Consultation K16914/1.  Councillor Carter, Ward Councillor, had also requested permission to address the Board on this item and on K17042, K17043 and K4303/7.  Councillor Wright, Ward Councillor, had requested permission to address the Board on item K17061.

The Development Services Manager submitted a report on applications received for planning consent setting out the recommendation in each case (a copy of which is attached in the Minute Book as Appendix ‘A’).

 

 

RESOLVED:  That the decisions be taken on each application for planning consent as detailed below:

 

 

 

Land At Cherry Close  Lee-on-the-Solent  Gosport  Hants

Members were informed that an amended drawing had been received on 13 January that satisfactorily addressed the concerns of the Head of Traffic Management and the Head of Contracts.

 

 

Councillor Carter, Ward Councillor and Chairman of the Housing Board, addressed the Board.  He confirmed that a report on applications K17042 and K17043 had come before the Housing Board on 11 January 2006.  The Housing Board had unanimously recommended these proposals to the Policy and Organisation Board, which would result in an additional 22 properties becoming available for Social Housing.

 

 

Members welcomed the proposal to replace the Orlit properties on this site.

 

 

RESOLVED:  That planning application K17042 – Land at Cherry Close  Lee on the Solent   Hampshire be approved subject to Section 106 Agreement relating to the payment of a commuted sum towards the provision of education facilities, outdoor playing space and a traffic regulation order and subject to the conditions set out in the report of the Development Services Manager, for the following reasons:

 

 

i.

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, it is considered that the proposal is acceptable in terms of impact on the character and visual amenities of the area and would not be significantly harmful to the amenities of existing or prospective occupiers or traffic/parking conditions in the locality.  As such, the development complies with Policies BE1, H5, H7, T6 and  RL10 of the Gosport Borough Local Plan and R/DP1, R/H5, R/T11, R/CF6 and R/OS7 of the Gosport Borough Local Plan Review.

Members were informed that one letter of objection and a petition containing 24 signatures had been received, clarifying the information contained in the report.  Members were further advised that the parking provision for 7 cars for the 15 residents currently in the home exceeded the maximum standards and that the addition of 1 more resident would not have a detrimental impact on the amenities of the area.

 

 

Councillor Carter, Ward Councillor, was invited to address the Board.  He informed Members that he knew the property well and that the rest home facility provided was an essential service to the area.  An increasing number of elderly residents were seeking this type of accommodation in the locality.  He had noted the number of cars parked at the property and considered 3 to be the average.  He noted the support of Social Services to the development and felt that the provision of accommodation for an additional resident was desperately needed.

 

 

Members considered the provision of charging points for battery driven wheelchairs but were informed that this provision was relevant for new build developments for the elderly but not for this application.

 

 

RESOLVED:  That planning application K4303/7 – 10 Britten Road  Lee on the Solent  Hampshire be approved subject to the conditions set out in the report of the Development Services Manager, for the following reasons:

 

 

i

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location and will not have any detrimental impact on the amenities of adjoining residents or in terms of highway safety. As such the proposal complies with Policies BE1, BE3, H10 and T6 of the Gosport Borough Local Plan and Policies R/DP1, R/DP7, R/H7 and R/T11 of the Gosport Borough Local Plan Review.

 

 

 

HMS Daedalus  Broom Way  Lee On The Solent  Hampshire   

 

 

Members were informed that a further 9 letters of objection had been received but they contained no additional issues to those outlined in the report.

 

 

In order to clarify the issues before the Board, the officer gave a brief résumé of the matters contained in the report.  He indicated that the relocation of the Coastguard building was not under review as planning permission had been granted in May 2005.  The proposed alterations to the fenestration of the building and minor alterations to the layout of the car park would not normally be a matter for the Board but were being considered alongside the extended MCA airfield perimeter to include the eastern runway to accommodate other existing airfield users, namely Hants Constabulary (Police spotter plane) and the Portsmouth Naval Gliding Club.  Because of the position of the Borough Boundary, the greater majority of the airfield lay within the area of Fareham Borough Council.  Gosport Borough Council had jurisdiction over the grass verge only.

 

 

In accordance with Standing Orders, Mr and Mrs Newsom were invited to address the Board.  Issues raised by them included:- an increase in noise from helicopters; proposed increase in the number of helicopters; hazardous liquid; runways near to new and existing houses; health and safety; expansion in the strategic gap; and the lack of an Environmental Impact Assessment. 

 

 

Margaret Kowalewska, Estate Manager, MCA was invited to address the Board.  She confirmed that this was not a new application for the entire site but concerned the additional land to the east to accommodate existing site users.  There were only 2 helicopters in use on the site and there were no plans to increase this number.  The application before the Board refers to the southern boundary fence only.

 

 

In answer to a Member’s question, it was confirmed that the access to the site was not included in the area under discussion and, therefore, if the application before the Board were to fail it would not impact significantly on the overall development.

 

 

Councillor Carter, Ward Councillor, was invited to address the Board.  He noted the objections to the development but commented that, as a result of speaking to many local residents, he had formed the opinion that the majority were in favour and wished the airfield to be retained.  This was an MOD development on an MOD site and it was planned to continue as such for the next 25 years.  Any other development on the site could have a far more grave impact on local residents.  Councillor Carter advised the Board that he lived near to the site and did not find the noise from aircraft to be a problem.

 

 

In answer to a Member’s question, it was confirmed that an Environmental Impact Statement was not required.  Mr and Mrs Newsom had referred the application to the Government Office for the South East who had confirmed, in a telephone call earlier in the day, that they would not be calling the matter in and that it should be determined at local authority level.

 

 

It was confirmed that a noise impact assessment would have been a matter for the previous application determined in May 2005 and was not a matter for consideration under this application. It was also confirmed that there were no plans to build a new runway, only for existing users to use the existing runways.

 

 

RESOLVED:  That no objection be raised on Circular 18/84 Consultation K16914/1 – HMS Daedalus  Broom Way  Lee on the Solent  Hampshire subject to the conditions set out in the report of the Development Services Manager, for the following reasons:

 

 

i

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in terms of its setting outside of the Urban Area Boundary and effect on the surrounding residential area and as such complies with Policies BE1, CY3 and MOD1 of the Gosport Borough Local Plan and Policies R/DP1, R/OS1, R/ENV6 and R/MOD1 of the Gosport Borough Local Plan Review.

Members were informed that a response had been received from Environmental Health indicating that there were no grounds for objecting to this development. 

 

 

Councillor Wright, Ward Councillor, was invited to address the Board and he confirmed that he was speaking on behalf of himself and Councillor Mrs Wright, also a Ward Councillor.  He expressed concern that the development proposed was in a densely populated area.  There were issues of noise and smell to consider and he had been made aware that Environmental Health would have concerns should these problems arise.  Should outbreaks of the bird flu virus spread to this country, this could also cause a hazard in such a populated area, particularly amongst families with young children. 

 

 

Councillor Wright was aware that the proposed steps required permission from Hampshire County Council.  However, he was concerned that the Cameron Close subway was already a gathering place for youths and there had been problems of graffiti, arson and vandalism in the area. 

 

 

Equipment and supplies required for the proposed site would have to be brought in via Cameron Close where there were already parking problems.

 

 

Councillor Wright requested that Members make a site visit, together with officers from the Hampshire County Council Highways Department, in order to see the potential problems for themselves.

 

 

In answer to concerns from Members, it was confirmed that in pre-application discussions, the applicant had indicated that he wished to grow produce and keep chickens for his own consumption and not as a business.  It was considered that the area was too small for viable business use.  Members were also advised that the applicant did not live in the vicinity of the site address.

 

 

Members considered that a site visit would assist in enabling them to reach a proper understanding of the proposed usage of the site and the Borough Solicitor confirmed to Members the criteria for undertaking site visits contained in the Constitution of the Council.

 

 

RESOLVED:  That planning application K17061 – Land to rear of 24 Cameron Close  Gosport    Hampshire be deferred for a site visit to enable Members to gather more information to enable them to make a decision.

 

 

 

 

 

Members were informed that the agents for this proposal had co-operated fully with officers in efforts to find alternative sites for this mast but that the proposed site provided the optimum radio coverage required by the Hampshire Police Authority.

 

 

Councillor Farr and Councillor Smith wished it to be recorded that they voted against the recommendation.

 

 

RESOLVED:  That planning application 15062/4 – Sanderson Centre  Lees Lane  Gosport  Hampshire be approved subject to the condition set out in the report of the Development Services Manager, for the following reasons:

 

 

i

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location and as such complies with Policies BE1 and CF8 of the Gosport Borough Local Plan and Policies R/DP1 and R/ENV9 of the Gosport Borough Local Plan Review.

 

 

 

 

 

In answer to Members’ questions, it was confirmed that there would be no problems with light spillage onto Haslar Road or Rampart Row.

 

 

RESOLVED:  That planning application K14129/22 – Haslar Marina  Haslar Road  Gosport  Hampshire be approved sub, ject to the conditions set out in the report of the Development Services Manager, for the following reasons:

 

 

i

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations the proposal will not diminish the Haslar Lake Urban Gap visually or physically, and will not be detrimental to landward or seaward views or the character and appearance of the area, or the interests of nature conservation, or the amenities of nearby residents. Furthermore the proposal will improve highway and pedestrian safety conditions and reduce the potential for criminal activity and anti-social behaviour in this locality.  As such, the development complies with Policies BE1, T6, CY2, CY3, CH1, CH9 and NC1 of the Gosport Borough Local Plan 1995 and R/DP1, R/T3, R/T11, R/CH1, R/OS1, R/OS2, R/OS9, R/OS10 and R/ENV7 of the Gosport Borough Local Plan Review.
