Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix ‘A’).  The report described the site and proposals, set out the planning history and assessed the development in the context of the Environmental Statement and supplementary documents submitted and relevant planning policies and guidance.
 
 
Amended landscape plans had been received on 12.01.05 with minor alterations relating to the enclosure of trees and the Tree Protection Plan and a letter received from the Applicant also dated 12.01.05 confirming that the granite sets on Heritage Way would be re-used.  English Nature and the Environment Agency had confirmed that the appropriate assessment was acceptable and the Environment Agency had removed their holding objection. 
 
The proposed conditions were tabled at the meeting and are attached at Annex 1.  The officer explained the relationship between the conditions and the issues set out in the report.
 
In response to Members’ questions, the officer explained the principal elements of the contamination, clarified details of the splash wall and flood mitigation plans, confirmed that the Arts and Crafts Centre would be part of the commercial use, addressed concerns about the provision for playing space by referring to the proposal to develop the ramparts as public open space and concerns about the construction traffic by referring to the Travel Plan provisions.
 
 
RESOLVED:  That having regard to the particulars of the application, the submitted plans and the information contained within the Environmental Statement to grant Planning Permission for the reasons set out in the report subject to the satisfactory completion of Section 106 obligations relating to the provision of affordable housing and open space and contributions towards transport improvements and the conditions set out in the annex to the report and subject to no direction from the Secretary of State calling in the application.

PROVISIONAL OFFER OF HISTORIC BUILDING GRANT:
BOX TOMBS AT ST MARY’S CHURCH  ALVERSTOKE  GOSPORT
 
 
Consideration was given to a report of the Director of Development and Environment (a copy of which is attached in the Minute Book as Appendix ‘B’).  The purpose of the report was to advise the Board of a proposed provisional offer of grant aid under section 57 of the Planning (Listed Buildings and Conservation Areas) Act 1990 to St Mary’s Church Alverstoke.
 
 
RESOLVED:  That the maximum grant of £2,500 pounds be offered towards the repairs of the box tombs in St. Mary’s Churchyard, Alverstoke, as specified in the report entitled “Conservation Report on the Churchyard Monuments, St Mary’s, Alverstoke, April 2003” by Matt Nation of Taylor Pearce Limited.

K16799 - DEMOLITION OF EXISTING DWELLING AND ERECTION OF A THREE STOREY BLOCK OF 12 NO. FLATS (as amplified by letters dated 04.11.04, 12.11.04 and 04.01.05 and amended by plans received 04.01.05)

Members were advised that a Tree Preservation Order had been made on 10.01.05.
 
 
In accordance with Standing Orders, Mr Webster was permitted to address the Board on behalf of the objectors.  He referred to the existing Covenant and queried why this type of development could be refused in Lee on the Solent but not in this location.  He expressed concern relating to the height of the proposed building; the position of the balconies leading to loss of privacy; the position of the parking area and its impact on neighbours by reason of noise and light pollution; loss of trees and the effect on wildlife; the existing drainage system capacity; the smell and nuisance from the bin storage area; the lack of fire exits and the fact that the loss of garden space would not be compensated for by taking contributions for the provision of playing space elsewhere.  He concluded by saying that that nearest play area was in Allenby Road and that the proposal constituted town cramming and should be refused.
 
 
In response to Members’ questions, the Borough Solicitor advised that the Covenant was not a planning issue.
 
 
Mr Ayles, of Latimer and Ayles Partnership, addressed the Board on behalf of the applicant.  He stated that the proposal, as originally submitted, was in line with policy but further amendments had been made to appease the concerns of local residents; the site was within a defined residential area; the building maintained the staggered alignment of existing development; the ridge height was very similar to that of the existing building; a Tree Preservation Order had been made and supplementary trees were proposed; the parking arrangement was similar to an existing arrangement in Redhouse Park Gardens and he was working with Southern Water to ensure the drainage arrangements would be satisfactory.
 
 
In response to Members’ questions, Mr Ayles confirmed that the windows to the balconies opened inwards; the existing and proposed trees would provide sufficient screening; that there was amenity space to the rear of the property next to the parking area and that access to the site was from Military Road.
 
 
To address Members’ concerns relating to wildlife conservation, officers proposed an additional condition requiring the submission of an ecological survey and mitigation measures if necessary.
 
 
Members expressed concern over the loss of existing family houses but accepted that it was central government policy to increase density in urban areas.
 
 
In response to Members’ questions, the officer confirmed that there was no objection to the access proposed on the grounds of highway safety and that the separation distances complied with the Local Plan policy.
 
 
RESOLVED:  That planning application K16799 – 54 Military Road, Gosport be approved subject to a Section 106 agreement relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager for the following reason and subject to the following new condition (Councillors Foster, Gill and Smith asked that their opposition to the decision be recorded):
 
 
Additional Condition 14An ecological survey of the site shall be undertaken and submitted to the Local Planning Authority for approval.  If there is any evidence of protected species or their habitats a scheme of mitigation shall be submitted to the Local Planning Authority for approval and thereafter implemented in accordance with the approved details before any development whatsoever pursuant to this permission is commenced.
 
ReasonTo mitigate any adverse impact on protected species and their habitats and to comply with Policies NC2 of the Gosport Borough Local Plan and R/OS12 of the Gosport Borough Local Plan Review.

Members were advised that three letters of objection had been received stating there would be no garden left; the house warrants preservation; increased traffic generation and on street parking; developer greed.
 
In response to Members’ questions, the officer confirmed the location of 3 houses for which outline consent was granted on land to the north of the site and that the property to the east of the site adjoining Fort Road was a care home; there was no justification for imposing a condition on wildlife conservation; the material for the garage door could be considered under the provisions of Condition 2 and that access to the site would be from Monckton Road.
 
 
RESOLVED:  That planning application K16823 – 47 Monckton Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:
