OFFER OF HISTORIC BUILDINGS GRANT FOR EMERGENCY STRUCTURAL WORKS TO LOCAL LISTED BUILDING AT 35 MILVIL ROAD,
LEE-ON-THE-SOLENT
 
 
Consideration was given to a report of the Director of Development and Environment (a copy of which is attached in the Minute Book as Appendix ‘A’).  The report requested that the Board considered a proposed retrospective offer of Historic Buildings Grant for emergency works to a Local Listed building at a level of 10%.
 
 
RESOLVED:  That an offer of £346, equal to 10% of the cost of works totalling £3466 be approved.

The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendation in each case (a copy of which is attached in the Minute Book as Appendix ‘B’).

K4186/9 - ERECTION OF THREE STOREY BLOCK OF 6NO. FLATS WITH ASSOCIATED PARKING, GARAGES AND CYCLE STORES

The officer confirmed that 12 Carnarvon Road would not be affected by loss of light and 6,8,10 and 12 Carnarvon Road would have an improved outlook.  In response to Members’ questions the officer advised that parking was within the maximum standards and that the existing use was likely to generate more traffic than the proposed development.
 
 
RESOLVED:  That planning application K4186/9 - 73/75 Gordon Road  Gosport be approved subject to Section 106 agreement relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location in terms of its scale and design and will not have any significant detrimental impact on the amenities of the area, adjoining and prospective residents or highway safety. As such the proposal complies with Policies BE1, H5, T6 and RL10 of the Gosport Borough Local Plan and Policies R/DP1, R/S8, R/T2, R/T11 and R/OS7 of the Gosport Borough Local Plan Review.

The officer clarified that 12am, referred to in paragraph 2 of the report, was 12 midnight and that the proposed changes only affected weekend opening times.
 
 
Members expressed concern that the present conditions had not been adhered to and requested that officers, when withdrawing the Enforcement Notice, send a letter to the applicant confirming the need to comply with the new conditions and the consequences if they did not.  Officers advised that the fact the applicant had not complied in the past was not a planning reason for refusal.
 
 
In response to Members’ questions it was confirmed that opening hours of the site would be monitored by officers and any complaint from a resident would be investigated and actioned promptly.
 
 
Councillor Farr wished it to be recorded that he voted against the recommendation.
 
 
RESOLVED:  That planning application for change of use K6785/5 - 93 Palmyra Road  Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the increase in opening hours will not have a detrimental impact on the neighbouring properties.  As such, the proposal complies with Policies BE1 of the Gosport Borough Local Plan and R/DP1 of the Gosport Borough Local Plan Review.

The officer explained that a class B8 (Storage/Distribution) use on this site had been approved and the containers constituted development in themselves which required planning permission.  For this reason condition 3 had been amended for clarification.  The containers could only be sited on the area hatched green on the plan.  Siting of containers elsewhere on the site would need a further application for planning permission.
 
 
RESOLVED:  That planning application K16550/1 - 154 Fareham Road  Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager for the following reason and subject to the following revised condition :
 
 
Revised condition 3:  The finished height of the containers above ground level shall not exceed 2.6 metres.
Reason:  In order to protect the amenities of the area and to comply with Policies BE1 of the Gosport Borough Local Plan and R/DP1 of the Gosport Borough Local Plan Review.

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, it is considered that the proposed use would preserve the character of the Conservation Area and would not be harmful to the visual amenities of the area, or the retail function of the shopping area, or parking provision in the locality. The proposal would also provide a comparable level of employment to the previous use. As such, the development complies with Policies BE1, EMP4, CF2, S2, BE9 and T6 of the Gosport Borough Local Plan and Policies R/DP1, R/BH1, R/EMP3, R/EMP5, R/CF1, R/S3, R/S5, R/T11, R/T2 and R/T3 of the Gosport Borough Local Plan Review.

That having regard to Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the building is well screened and will have no impact on the amenities for the locality if retained for only a limited period and there is sufficient parking available until the residential development is fully occupied.  As such the proposal complies with Policies BE1 and T6 of the Gosport Borough Local Plan and R/DP1 and R/T11 of the Gosport Borough Local Plan Review.

The officer confirmed that the recommendation was subject to the completion of a Section 106 agreement and that condition 4 had been revised to clarify timescales in relation to facilities for the storage of refuse as the application was retrospective.
 
 
RESOLVED:  That planning application K6653/5 - 23 Brockhurst Road  Gosport be approved  subject to Section 106 agreement relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager for the following reason and subject to the following revised condition : 
 
 
Revised Condition 4:  Details of the facilities to be provided for the storage of refuse for removal from the premises shall be submitted to the Local Planning Authority for approval within one month from the date of the planning permission.  The facilities shall be provided within one month from the date that the details are approved, in writing, by the Local Planning Authority and shall thereafter be retained and maintained.
Reason:  In order to protect the amenities of the area, and to comply with Policies BE1 of the Gosport Borough Local Plan and RDP/1 of the Gosport Borough Local Plan Review.

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, it is considered that the use of the property as two flats is not harmful to the character or visual amenities of the area, the amenities of existing or prospective occupiers, or parking provision in the locality. As such, the development complies with Policies BE1, BE3, H5, H9, T6 and  RL10 of the Gosport Borough Local Plan and Policies R/DP1, R/DP7, R/H7, R/S8, R/T11 and R/OS7 of the Gosport Borough Local Plan Review.

K16770 - AMENDMENTS TO CONDITIONS - PRIDDY’S HARD, HERITAGE WAY, GOSPORT
 
 
By reason of special circumstances, the Chairman determined that this item be considered at this meeting notwithstanding the fact that the item had not been available for public inspection in accordance with the provisions of Section 100B(4)(a) of the Local Government (Access to Information) Act 1985.  The special circumstances were created because of recent information received regarding a badger sett. 
 
 
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix ‘C’).  The officer confirmed the status of the application and explained that prior to issuing a decision notice minor changes to the wording of the conditions were required to allow for the submission of amended plans.
 
RESOLVED:  That the conditions as amended be approved.
