It was reported that, in accordance with Standing Orders, Councillor Hayward had been nominated to replace Councillor Foster for this meeting.

122 TREE PRESERVATION ORDER G111
Trees at Rochford House, Newton Place, Lee-on-the-Solent
Consideration was given to a report of the Borough Solicitor (a copy of which is attached in the Minute Book as Appendix ‘A’). The purpose of the report was to request the Board to consider whether to confirm, amend and confirm, or not to confirm Tree Preservation Order G.111 where an objection had been received.
In answer to a question, Members were informed that should the Tree Preservation Order be confirmed, the onus would be on the owner to prove that the roots were causing subsidence to the property should he wish to apply for removal of the trees in the future.
RESOLVED: That, in accordance with the provisions of Section 199 of the Town and Country Planning Act 1990 and despite a letter of objection, the Board confirm Tree Preservation Order No G.111 relating to two sycamore trees at Rochford House.
123 DEVELOPMENT CONTROL PERFORMANCE 01.10.04 – 31.12.04
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix ‘B’). The purpose of the report was to set out the background to the Best Value Performance Indicators relating to speed of determining planning and other applications; performance against government and local targets in relation to applications; and performance in resolving complaints relating to possible breaches of planning control.
In answer to a Member’s question, it was confirmed that 106 Agreements were completed prior to planning applications being considered and therefore the legal process did not delay the planning process. It was also confirmed that officers had not yet been informed of the amount of Planning Delivery Grant to be received based on current performance delivery. It was explained that the number of enquiries relating to possible breaches of planning control actioned in this quarter included enquiries received in the last quarter, which was why 39 enquiries had been received and 40 actioned.
RESOLVED: That the Development Control performance 01.10.04 – 31.12.04 be noted by the Board.
124 REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendation in each case (a copy of which is attached in the Minute Book as Appendix ‘C’).
RESOLVED: That the decisions be taken on each application for planning consent as detailed below:

In response to a Member’s question, the officer confirmed that there was no minimum parking standard with which it was necessary to comply.
RESOLVED: That permission be approved subject to a Section 106 Agreement relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:
i That, having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location in terms of its design and will not have any significant detrimental impact on the amenities of the area, adjoining and prospective residents or highway safety. As such the proposal complies with Policies BE1, H5, H9, S3, T6 and RL10 of the Gosport Borough Local Plan and Policies R/DP1, R/H7, R/S6, R/S8, R/T11 and R/OS7 of the Gosport Borough Local Plan Review.

It was confirmed to Members that the decision would not be issued until the legal agreement relating to Planning Permission K16770 had been completed.
In response to a Member’s question, it was confirmed that over-wintering birds would have left the area by 31 March.
RESOLVED: That conservation area consent application K16770/1 Former Cartridge Store Building Priddy’s Hard Heritage Area Heritage Way Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:
i The building has little architectural merit and any historic significance will be recorded. A replacement scheme has been approved which will preserve and enhance the conservation area and a condition will ensure that there is no disturbance to overwintering wildfowl. As such the proposal complies with Policies BE10, BE15 and NC1 of the Gosport Borough Local Plan and R/BH2, R/BH7 and R/OS9 of the Gosport Borough Local Plan Review.

The Regulatory Services Manager reported to the Board the outcome of recent planning appeals relating to decisions made under delegated powers concerning 31 Monkton Road, 73 Western Way and 7 Bridgemary Grove. In each case the original decision had been upheld on appeal.
