HISTORIC BUILDINGS GRANT OFFER
 
Admiralty Cottage 42 Crescent Road  Gosport
 
The Board considered the report of the Director of Development and Environment (a copy of which is attached in the Minute Book as Appendix ‘A’) requesting that they approve the recommendation to offer a Historic Buildings Grant for replacement hardwood windows to Admiralty Cottage, 42 Crescent Road (Conservation Area).
 
RESOLVED:  That the Board approve an offer of £486.30 being 10% of the lowest of two comparable quotes, submitted by BJH Windows Ltd in the sum of £4863.00, as the works represent an enhancement of the building and the Conservation Area.

HISTORIC BUILDINGS GRANT OFFER
 
5 Grange Farm  Gosport
 
 
The Board considered the report of the Director of Development and Environment (a copy of which is attached in the Minute Book as Appendix ‘B’) requesting that they approve the recommendation to offer a Historic Buildings Grant for the replacement of four windows to 5 Grange Farm (Listed Building).
 
 
RESOLVED:  That the Board approve an offer of £495.00, being 15% of the lowest of three comparable quotes, submitted by Period Joinery in the sum of £3300.00.

REPORTS OF THE REGULATORY SERVICES MANAGER
 
 
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendation in each case (a copy of which is attached in the Minute Book as Appendix ‘C’).

K668/2 - RETENTION OF CONSERVATORY

Members were informed that a further letter of objection had been received from the same objector mentioned in the report, stating that he was unable to attend the meeting but asked that consideration be given to the provision of a solid wall on the north end of the conservatory.
 
 
Members were informed that the original specification for the conservatory for which planning permission had been granted, stated that the end wall of the conservatory would be a solid wall.  By “solid”, the manufacturer had meant that the wall would be opaque materials rather than transparent glass, not that the wall would be solid in the sense of being built of brick.  There was nothing in the original application defining the word “solid” and this had led to a misunderstanding of how the conservatory would be constructed. 
 
 
Members were further informed that the conservatory had required planning permission because of its size and that had it been smaller, such permission would have been unnecessary.
 
 
Members considered that noise levels emanating from use of the conservatory would be no greater than those produced by the applicant making use of the garden during summer months.
 
 

 
RESOLVED:  That planning application K668/2 – 31 Prideaux Brune Avenue  Gosport Hampshire be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:

 
 
i
That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed by reason of its design, siting and orientation, will not have a detrimental impact on the neighbouring properties or the visual amenities of the area.  As such, the proposal complies with Policies BE1 and BE3 of the Gosport Borough Local Plan and R/DP1 and R/DP7 of the Gosport Borough Local Plan Review.

Members were informed that, despite the proximity of this mast to Grange Juniors and Infants Schools, an ICNIRP Certificate had been received and therefore health and safety issues were not a consideration for the Board.  No objection had been received from the Schools.
 
 
RESOLVED:  That planning application K16983 –Highway Verge at Grange Lane  Gosport  Hampshire be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
 
 
i
That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location and as such complies with Policies BE1, BE9 and CF8 of the Gosport Borough Local Plan and Policies R/DP1, R/BH1 and R/ENV9 of the Gosport Borough Local Plan Review.

Members were informed that a letter had been received from Brune Park School stating that the School had no objection to the mast.
 
 
RESOLVED:  That planning application K16984 – Highway Verge at Military Road  Gosport  Hampshire be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
 
i
That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the development as proposed is acceptable in this location and as such complies with Policies BE1 and CF8 of the Gosport Borough Local Plan and Policies R/DP1 and R/ENV9 of the Gosport Borough Local Plan Review.

K15062/4 - RETENTION OF 25 METRE HIGH MONOPOLE TELECOMMUNICATIONS MAST AND EQUIPMENT CABINETS (as amplified by letter dated 25.08.05)

Members expressed concern that this mast had originally been granted temporary consent with the understanding that the equipment would eventually be housed permanently on the top of a building.
 
 
Members were advised that were the mast to be granted planning approval, the present equipment cabinets would be tidied and a more suitable fence installed around the equipment as shown on the application drawings.
 
Members voted not to grant approval for the mast, as its permanent siting in this position was contrary to Policy R/ENV9 of the Gosport Borough Local Plan Review.  A motion to refuse was lost.
 
RESOLVED:  That planning application K15062/4 – Sanderson Centre  Lees Lane  Gosport Hampshire be deferred for officers to consult further with the applicants on the feasibility of site sharing with an existing mast or of finding an alternative location.

K16770/5 - CONSERVATION AREA APPLICATION - REPLACEMENT OF EXISTING BOUNDARY FENCE (as amplified by plans received 25.07.05)

Members were informed that planning permission for the replacement fence had been granted at the previous meeting of the Regulatory Board.
 
 
In answer to a Member’s question, it was confirmed that the issue of access to the Shell Filling Rooms was not a matter for determination by the Board.
 
 
RESOLVED:  That Conservation Area Consent application K16770/5 – Priddys Hard Heritage Site  Gosport  Hampshire be approved for the following reason:
 
 
i
That having regard to Section 38(6) of the Planning and Compensation Act 2004 and all other material considerations, the minor nature of the operations required will have little or no impact on the Scheduled Ancient Monument.  The existing fence does not make a positive contribution to the character and appearance of the Conservation Area.  A replacement fence more acceptable in terms of design and construction has been approved. The proposal therefore complies with Policies BE10 and BE15 of the Gosport Borough Local Plan and R/BH2 and R/BH7 of the Gosport Borough Local Plan Review.

Site Visits
 
 
Members discussed the necessity of holding site visits and concluded that, not only was it helpful for Members of the Board to undertake a site visit to clarify details of an application before them, it also enabled objectors to see that such detailed clarification was being undertaken where an application generated considerable opposition from neighbours.
 
 
b.
K16713/1 - Royal Clarence Yard
 
 
 
The Borough Solicitor needed to raise an issue in relation to the forthcoming Royal Clarence Yard Public Inquiry and as she would be providing legal advice the Board was asked to consider dealing with the matter as an exempt item under Paragraph 12 of Schedule 12A of the Local Government Act 1972.
 
 
 
Note:  Councillor Taylor and Councillor Smith declared a personal and prejudicial interest in this item, left the room and took no part in the discussion or voting thereon.  Councillor Allen took the Chair for the duration of this item.
 
 
 
By reason of special circumstances, the Chairman determined that this item be considered at this meeting notwithstanding the fact that the item had not been available for public inspection in accordance with the provisions of Section 100B(4)(a) of the Local Government (Access to Information) Act 1985.
 
 
 
The Board agreed that the matter should be dealt with as an exempt item and passed the following resolution.
 
 

 
 
RESOLVED:  That
 
a)         Under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the under-mentioned items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 12 of Schedule 12A of the Act; and
 
 
 
b)         That the Board authorises the Borough Solicitor to enter into Planning Obligations relating to the provision of open space and highway matters where this is in the best interests of the Council at the forthcoming Inquiry into planning application K16713/1 – Royal Clarence Yard.
