The Mayor (Councillor Burgess)(ex-officio), Chairman of Policy and Organisation Board (Councillor Hook)(ex-officio), Councillors Allen (P), Carr (P), Clinton (P), Davis (P), Edwards (P), Farr, Foster (P), Smith (P), Taylor (P) and Train (P).
 
 
It was reported that, in accordance with Standing Orders, Councillor Edwards had been nominated to replace Councillor Mrs Champion on this Board for the remainder of the Municipal Year 2005-2006.
 
 
It was reported that, in accordance with Standing Orders, Councillor Mrs Cully had been nominated to replace Councillor Farr for this meeting.

RESOLVED:  That the Minutes of the Regulatory Board meeting held on 11 October be amended to reflect the fact that Councillor Gill had been nominated to replace Councillor Smith for the meeting and not Councillor Rigg as stated.  The Chairman approved and signed the amended Minutes as a true and correct record.

DEVELOPMENT CONTROL PERFORMANCE 01.07.05 – 30.09.05
 
 
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix ‘A’).  The purpose of the report was to set out the background to the Best Value Performance Indicators relating to speed of determining planning and other applications; performance against government and local targets in relation to applications; and performance in resolving complaints relating to possible breaches of planning control.
 
The Chairman advised the Board that the presentation of this report brought the Performance reporting process up to date.  The previous report noted by the Board in October had been delayed owing to the heavy workload of officers involved in the Berkeley Homes Planning Appeal.
 
RESOLVED:  That Development Control performance 01.07.05 – 30.09.05 be noted by the Board.

REPORTS OF THE REGULATORY SERVICES MANAGER
 
 
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendation in each case (a copy of which is attached in the Minute Book as Appendix ‘B’).
 
 
RESOLVED:  That the decisions be taken on each application for planning consent as detailed below:

Note:  Councillor Smith declared a personal and prejudicial interest in this item, left the room and took no part in the discussion or voting thereon.
 
 
Members were informed that a further letter had been received from Lee Residents Association, reference L10a.  Satisfaction had been expressed at proposed improvements to the service road but there was still concern that the siting of the flats was too close to the highway frontage.
 
 
Members considered the provision of affordable housing on the site and were assured by officers that every effort was being made by the developers to reach a satisfactory agreement over the provision of 40% affordable housing.

 
 
In answer to a Member’s question, the Board were informed the contribution towards education provision would be made to Hampshire County Council as the Education Authority but would be designated for use in the Gosport area. 
 
Officers presented an amended Recommendation to the report, which included the provision for authority to be delegated to the Development Services Manager to refuse planning permission should a satisfactory 106 obligation not be completed by 23 November 2005.
 
 
RESOLVED:  That planning application K16401/4 – 38-42 Marine Parade East  Lee On The Solent  Hampshire be approved subject to the satisfactory completion of a Section 106 obligation by 23 November 2005, relating to:-
 
1.                  affordable housing
2.                  outdoor playing space
3.                  educational facilities
4.                  highway improvements
5.                  traffic regulation order
 
If a satisfactory Section 106 obligation has not been received by this date, delegated authority is granted to Development Services Manager to refuse planning permission for reasons of unsatisfactory provision of those matters specified above.
 
Planning permission was also subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
 
 
i.
That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the proposal is acceptable in this location in land use and design terms, will be in keeping with the character and appearance of the Marine Parade Area of Special Character and will not be harmful to the amenities of existing and prospective occupiers.  As such the development complies with Policies BE1, BE7, H5, H7, T6, T8 and RL10 of the Gosport Borough Local Plan and Policies R/DP1, R/DP10, R/H1, R/H4, R/H5, R/T2, R/T3, R/T11, R/DF6 and R/OS7 of the Gosport Borough Local Plan Review.

In answer to a Member’s question, it was confirmed that the area of land was not large enough to support a separate dwelling.
 
 
RESOLVED:  That planning application K17018 – 89 Gregson Avenue  Gosport  Hampshire be approved subject to the condition set out in the report of the Regulatory Services Manager, for the following reason:

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act 2004 and all other material considerations, the proposals, by reason of their location, design and orientation, would not have a detrimental impact on the neighbouring properties or the visual amenities of the area.  As such, the proposal complies with Policies BE1, BE3 and RL9 of the Gosport Borough Local Plan and R/DP1, R/DP7 and R/OS3 of the Gosport Borough Local Plan Review.
