REVIEW OF HACKNEY CARRIAGE FARE TARIFF
 
 
Consideration was given to a joint report of the Regulatory Services Manager and Financial Services Manager.  Additional information and revised recommendation was tabled at the meeting (copies of which are affixed in the Minute Book as Appendix "A").
 
 
Members were informed that the Council reviewed the Hackney Carriage fare tariff for vehicles operating in the Borough on an annual basis.  The means adopted to carry out this review was in line with a formula that had been agreed by the Licensing Sub Committee meeting on 4 October 2001 following consultation with the trade.
 
 
At a meeting held in the Town Hall on 4 May 2004, the trade was consulted on the proposed increases to the tariff.  Two options had been presented at that meeting and, at that time, the majority of the trade expressed a preference for the method to reduce the number of metres per 20 pence charged after the first 706 metres from 251 metres to 230 metres.
 
 
Although a strong preference had been indicated at the meeting on 4 May 2004 for the option detailed above, a subsequent survey of all the operators had highlighted a strong majority expressing a preference for the alternative option.  This consisted of an increase in the charge for the first 706 metres of 10 pence to £2.30 with subsequent distances reduced from 251 metres to 239 metres for each 20 pence charged.
 
Members were informed that whilst the recent increase in fuel prices had not yet been taken into account in the current formula the Board could reconsider the appropriate tariff if a substantial increase in fuel costs occurred during the year.  Members were informed that the formula used was the same for the two options presented at the meeting on 4 May 2004 and this formula was used to produce the percentage increase.
 
The Chairman commented that there was now a sound system in place to review the Hackney Carriage fare tariff annually which was fair to the trade and to the public.
 
 
RESOLVED:  That an increase in the maximum level of Hackney Carriage Fares chargeable to £2.30 for the first 706 metres and a 20 pence charge for each subsequent 239 metres applicable from the 1st August 2004 be approved.

Members were informed that amended plans had been received on 14 May 2004 indicating changes to landscape planting and the addition of high level windows on the north elevation.
 
 
RESOLVED:  That planning application K.13430/3 – 34 The Crossways, Gosport be approved subject to the developer entering into a planning obligation under Section 106, as approved by the Council, relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space, and subject to the conditions set out in the report of the Regulatory Services Manager for the following reason:
 
 
i.
That having regard to the provisions of Section 54A of the Town and Country Planning Act 1990 and all other material considerations, the dwellings can be accommodated on this site without any detriment to the visual amenities of the area and in accordance with the parking standards and open space requirements. Furthermore, the design of the property is such that the proposal will not adversely affect the residential amenities of neighbouring residents.  As such the proposal complies with Policies BE1, H5, T6 and RL10 of the Gosport Borough Local Plan and Policies R/DP1, R/T11 and R/OS7 of the Gosport Borough Local Plan Review.

(NB.  Linda Edwards, Borough Solicitor declared a personal interest in the above item by virtue of living nearby, left the room and did not take part in the discussion or voting thereon.)
 
 
Members were informed that a second letter had been received from the occupier of St Peter's Cottage, Ellachie Mews, Gosport which summarised a report by Car Parking Solutions who had carried out a risk assessment of the access.  The concerns were that access to the site was dangerous for pedestrians and other users of the highway.  The officer reported that the access already existed and in view of the location of the site at the end of the cul-de-sac there would be a limited number of additional vehicular or pedestrian movements and that a refusal could not be justified on Highway Safety grounds.
 
 
In accordance with Standing Orders, Doctor North was permitted to address the Board on behalf of the objectors.  Doctor North gave an information sheet to the Chairman and made the following points:
 
 
 
·        That to permit the proposal would neither preserve nor enhance the special character of the Conservation Area.
·        The spaces surrounding the buildings in the Conservation Area and the buildings themselves needed to be improved and preserved.
·        The plan attached to the planning application was not up to date, additions had been made to some of the properties.
·        The garden space of Monckton Cottage would be affected in that its character would not be in harmony with the other gardens.
·        The gardens were integral elements of the area.
·        The proposal would absorb a considerable amount of garden space, would not provide harmony and would impact on similar properties in the area.
·        The properties were individual and significant, and as a whole formed a Conservation Area.
 
 
Mr Collins, the applicant, was invited to address the Board.  Mr Collins made the following points:
 
 
 
·        He would be happy for the Members to visit the site and negotiate improvements.
·        He would be happy for the landing window to be obscure glazed and for the window of bedroom 4 to be re-located to overcome problems of overlooking.
·        He would carry out the works with the minimum of disruption.
·        The access gates were to be removed.
·        Improvements to the access would allow vehicles to exit in forward gear whereas now they often reverse out.
 
 
The Chairman pointed out that site visits were only carried out in exceptional circumstances and asked the applicant if he would accept a condition to obscure glaze the landing window.  The officer advised that the re-location of the fourth bedroom window would have an adverse effect on the design of the building and in view of the distance to the rear elevations of the houses in Ellachie Road and the existing tree screen there would not be a significant loss of privacy if the bedroom window was retained.  The officer also confirmed that the issue of fire safety would be dealt with through the Building Regulations and that the arrangements for collecting refuse were satisfactory.
 
 
The following additional condition was agreed:
 
The windows on the north west elevation outlined in green on the approved plan shall be glazed with obscure glass and shall be retained in that condition.
Reason:  To preserve the amenity of the adjoining property, and to comply with Policies BE1 and BE3 of the Gosport Borough Local Plan.
 
RESOLVED:  That planning application K.16086/1 – Land Adjoining Monckton Cottage, Ellachie Mews, Gosport be approved subject to the developer entering into a planning obligation under Section 106, as approved by the Council, relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space, and subject to the conditions set out in the report of the Regulatory Services Manager, and subject to the above additional condition for the following reason:
