[It was reported, that in accordance with Standing Orders, Councillor Hayward had been nominated to replace Councillor Taylor for the meeting].
57. K.12255/2 – ERECTION OF SINGLE/TWO STOREY CATERING
FACILITY WITH FIRST FLOOR BALCONY , COVERED SEATING
AREA AND LANDSCAPING

Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix "A").
Members sought clarification on how the Council's decided whether an application was a departure application or not. It was reported that if the application had been deemed a departure then it would have had to have gone to the Deputy Prime Minister's office to decide.
Concern was also raised about the Environment Agency's letter regarding their views on the proposal. Members were informed that currently no further update from the Agency had been received, other than the letter attached to the report as Appendix 2. Members were made aware of two conditions the Environment Agency had insisted upon in the letter which were included in the conditions of the report. It was also reported to Members that under the Water Resources Act, the Environment Agency were only likely to agree to consent under this Act if the site was a minimum of 8 metres away from the River Alver. Members were informed that if the application needed to be re-sited then this could result in another planning application coming before the Board.
RESOLVED: That conditions 1 – 7 as set out in Section 3 of the report be attached to Planning Permission K.12255/2 in accordance with the resolution of the Regulatory Board at the meeting on 17 June 2003.
58. ANY OTHER BUSINESS
Members were informed that Mr A. M. Pepall, recently refused a Private Hire and Hackney Carriage Vehicle Licence had appealed to the Magistrates Court in light of the Board's decision dated 20 May 2003.
Members were also made aware of training for Regulatory Board members to take place on the 17 July 2003.
