RESOLVED: That the Minutes of the Regulatory Board held on 4 November 2003 be approved and signed by the Chairman as a true and correct record.

It was reported that deputations had been received on planning applications K.16248/1, K.8546/4 and K.16472, and item 167. Summary Of The Office Of Fair Trading Report On The Regulation Of Licensed Taxi And Private Hire Vehicle Services In The UK.
144. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "A").
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
145. K.16248/1 – CHANGE OF USE FROM SHOP (CLASS A1) TO TAKEAWAY (CLASS A3) RETENTION OF SHOP FRONT AND INSTALLATION OF VENTILATION / EXTRACTION SYSTEM (CONSERVATION AREA) (as amplified by letter dated 27.10.03)

Members were informed that the description of the proposal had been changed to the following for more clarity:
Change of use of no. 71 Stoke Road from shop (Class A1) to takeaway (Class A3), retention of existing works and further works to shop front of no. 71 Stoke Road and installation of ventilation / extraction system (Conservation Area)

Members were informed that a previous planning application for this site had been refused and that an appeal had been lodged. Members were informed that a letter had been received from the applicant stating that if this planning application was successful the appeal would be withdrawn. Members were advised that in order to control the use of 73A Stoke Road as a shop, it was proposed to amend the recommendation to:
GRANT PERMISSION
"subject to the developer entering into an obligation under 106 of the Town and Country Planning Act 1990 to use the premises 73A Stoke Road only as a shop";
and to delete condition 5.
In accordance with Standing Orders, Mrs Searle was permitted to address the Board. Mrs Searle made the following points:
· That she spoke on behalf of all the concerned local residents;
- That action should have been taken sooner to limit the number of takeaways on Stoke Road;
- If granted strict opening hours be enforced limiting opening times to 11am – 11pm Monday to Saturday, and 11am – 10.30pm Sunday.
In accordance with Standing Orders, Councillor Mrs Cully was permitted to address the Board as Ward Councillor for the residents of Chester Court. Councillor Mrs Cully made the following points:
· That by moving the takeaway from no.73 to no.71, there would be an even greater detrimental effect on local residents as the ventilation system would be closer to bedroom windows;
- That the application was set within a Conservation Area and a Shopping Area which was contrary to policies BE1, BE9 and S2 of the Gosport Borough Local Plan;
- The layout of the proposed site would have a detrimental effect on residents due to noise, smells and waste;
- That the access proposed to the rear of the sight was not safe or convenient for residents and that this contravened policy T6 of the Gosport Borough Local Plan;
- That there was inadequate waste storage facilities at the rear of the proposed site;
- The Council should be encouraging greater diversity which this application failed to provide.
Members expressed concern about the location of the proposed takeaway. It was felt that it would inappropriate in terms of the amenity of the area and contravened Gosport Borough Local Plan polices relating to Conservation Areas. Members were also unhappy with the proposed siting of the ventilation fans and waste bins, feeling they would have a detrimental effect on local residents.
RESOLVED: That planning application K.16248/1 – 71, 73 and 73a Stoke Road, Gosport be refused for the following reasons:
- The proposed change of use will generate noise, litter and disturbance, especially in view of the unsociable opening hours, thus causing harm to the amenities of local residents, contrary to policies S2 and BE1 of the Gosport Borough Local Plan and policy R/DP1 of the Gosport Borough Local Plan Review.
- The proposed change of use of no 71 Stoke Road to a food outlet will result in an imbalance between shopping and non-shopping outlets, thus causing harm to the character of the Stoke Road Conservation Area contrary to policy BE9 of the Gosport Borough Local Plan and policy R/BH1 of the Gosport Borough Local Plan Review.
- The proposed ventilation/extraction system will be visible from Stoke Road and by reason of its design, location and appearance will cause harm to the appearance of the Stoke Road Conservation Area contrary to policy BE9 of the Gosport Borough Local Plan and policy R/BH1 of the Gosport Borough Local Plan Review.
- The proposed ventilation/extraction system is an intrusive feature located in close proximity to the bedroom windows of adjacent residential properties which is likely to result in noise and odour. As such it is detrimental to the residential amenities of the occupiers of such properties contrary to policies S2 and BE1 of the Gosport Borough Local Plan and policy R/DP1 of the Gosport Borough Local Plan Review.
146. K.8546/4 – INSTALLATION OF 6no. SECTORED ANTENNA,
1no. COMMUNICATIONS DISH, RADIO EQUIPMENT HOUSING
AND ANCILLARY STRUCTURE (ADJACENT TO CONSERVATION
AREA) (amended drawings received 21.10.03)
GOSPORT BT EXCHANGE, STOKE ROAD, GOSPORT
Members were informed that local residents had submitted a petition of 144 signatures objecting to the proposal. It was also reported that this application had been deferred from July's Regulatory Board meeting and withdrawn from September's Regulatory Board meeting, and that the report had been amended to reflect this.
In accordance with Standing Orders, Captain Rimmington was permitted to address the Board on behalf of the objectors. Captain Rimmington made the following points:
· That the proposed siting of the antenna would be visually detrimental to the area;
· The proposal contravened Gosport Borough Local Plan policies BE1, BE9 and CF8 in terms of their location, form scale and appearance;
· The proposed aerials were in close proximity to three local schools, which, considering the Council's own policy of not allowing masts on it's land within 500 metres of school property, seemed contradictory;
· The full health implications of these masts were still not known and the current health certificate attainable were not stringent enough;
· This would set a precedent and allow other phone companies to erect masts on similar sites.
Members expressed concern that no response had been received from the three local schools. They were informed by Officers that the schools had been contacted each time the application came before the Board but that on each occasion no response had been received. Members asked Officers whether it was necessary for the phone company to have come to the Regulatory Board and were informed that as a matter of courtesy they had made a full planning application rather than using the 'prior approval' procedure because of the proximity of the Bury Road Conservation Area. Members also raised concern about the health and safety implications of having six new masts on the building. Members were informed that the ICNIRP certificate was compiled on the basis of both existing and proposed masts being used at the same time.
RESOLVED: That planning application K.8546/4 – Gosport BT Exchange, Stoke Road, Gosport be refused for the following reasons:
i. The proposal structures, by reason of their location, form, scale and external appearance, and the proliferation of such structures on the roof of the BT Exchange building, would be harmful to the character and appearance of the area, contrary to Policy BE1 and CF8 of the Gosport Borough Local Plan and Policies R/DP1 and R/ENV9 of the Gosport Borough Local Plan Review.
ii. The proposal structures, by reason of their location, form, scale and external appearance, would neither preserve nor enhance the setting of the Bury Road Conservation Area, contrary to Policies BE1 and CF8 of the Gosport Borough Local Plan and Policies R/DP1 and R/ENV9 of the Gosport Borough Local Plan Review.
147. K.16472 – INCREASE IN ROOF PITCH TO DWELLING AND
ERECT SIDE DORMER WINDOW (as amended by plans

45 LEAMINGTON CRESCENT, LEE-ON-THE-SOLENT
In accordance with Standing Orders, Councillor Carter was permitted to address the Board as Ward Councillor. Councillor Carter made the following points:
- The dwelling was situated among a row of similar single storey bungalows and the proposal would be out of keeping with the area;
- There was only a gap of 3.5 metres between this building and it's neighbour, which was too small to allow the build to take place, as shown in policy BE3 of the Gosport Borough Local Plan;
- The windows the applicant intends to use will all be at viewing height, and therefore invasive of next doors privacy;
- There would be virtually total loss of light for no. 43 Leamington Crescent, especially during the winter months;
- A matter of interpretation, it is possible to refuse the application based on policies BE1 and BE3 of the Gosport Borough Local Plan.
In accordance with Standing Orders, Mr Birch was permitted to address the Board as the applicant. Mr Birch made the following points:
- There was no uniformity along Leamington Crescent, several bungalows had already been altered;
- Not seeking to set a precedent, but this has already been done along the road;
- The rooms affected in no. 43 Leamington Crescent are rooms which are not frequently used. One is a garage, the other a bathroom;
- There would be zero loss of privacy for the neighbours as the new windows would actually be further away than they are now;
- He was not operating a business from the premises, he merely parks his van there overnight;
- The proposal would have a positive effect on the area, it would raise house prices;
- As a matter of interpretation, the planning application complies with policies BE1 and BE3 of the Gosport Borough Local Plan.
RESOLVED: That planning application K.16472 – 45 Leamington Crescent, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. That having regard to the provisions of Section 54A of the Town and Country Planning Act 1990 and all other material considerations, the development constitutes an appropriate addition to the roof in form, scale, height and external appearance which is acceptable in the street scene and will not significantly affect the amenities of occupiers of adjacent residential properties. As such the proposal complies with Policies BE1 and BE3 of the Gosport Borough Local Plan and Policy R/DP1 of the Gosport Borough Local Plan Review.

Members raised concern over the opening hours of the takeaway and were pleased to note condition 4, which limited the opening hours. It was also noted that the premises next to this dwelling was continually flaunting their opening hours provision. Members were informed that this was currently being investigated and that this premises would also be monitored.
RESOLVED: That planning application K.16476 – 95 Palmyra Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. That having regard to the provision of Section 54A of the Town and Country Planning Act 1990 and all other material considerations, it is considered that the proposal would neither be harmful to the retail function of the shopping centre, the amenities of adjacent residential properties nor the visual amenities of the locality and, as such, complies with Policies BE1, BE3, S2, S4 and T6 of the Gosport Borough Local Plan and Policies R/DP1, R/DP7, R/S4 and R/T11 of the Gosport Borough Local Plan Review.

Members were informed that two further letters of objection had been received, one of which was from the original objector. Members were informed that the matters raised in the letters were private, legal issues, not material planning considerations.
RESOLVED: That planning application K.2611/5 – Alver Road, Gosport be approved subject to the developer entering into a planning obligation under Section 106 of the Town and Country Planning Act 1990, as approved by the Council, relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. That having regard for Section 54A of the Town and Country Planning Act 1990 and all other material considerations, the two dwellings of the scale and design proposed can be accommodated on this site without any detriment to the character and visual amenities of the area and in accordance with the parking standards and open space requirements. Furthermore, as the existing property is derelict the proposed scheme would be a major visual improvement on this prominent corner site. Moreover, the design of the properties is such that there will be no unacceptable overlooking of adjoining properties and the front porches will not adversely affect the amenities of neighbouring residents. RESOLVED: That planning application K.16501 – Units 14-17, Cooperage Green, Royal Clarence Yard, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. Members were informed that this was a retrospective planning application and the description should be amended to "retention of a portable building". It was also proposed that Condition 1 be amended limiting the time period from 31.12.2004 to 30.06.2004 and reference to the Daedalus Action Group be omitted.
Concern was raised by Members over the stationing of a building of this nature on the seafront. Members were advised that in view of the short time period the objectives to retain the land as open space would not be prejudiced in the long term.
RESOLVED: That planning application K.16480 – Land Adjacent to Flower Buildings, Marine Parade East, Lee-on-the-Solent be refused for the following reason:
i. The portable building is of an unacceptable design in this location and will prejudice the policy objectives to retain this as open land for recreational and leisure facilities. As such the proposal is contrary to policies CH1, CH9 and CY3 of the Gosport Borough Local Plan and policies R/L6, R/CH1 and R/OS1 of the Gosport Borough Local Plan Review.

Members were informed that the Environment Agency had a holding objection to the proposal because contamination remediation of this part of the site had not yet been validated. It was reported, however, that this area had been remediated and Condition 6 of Outline Consent K.15500 required this work to be validated before the waterfront was brought into use.
RESOLVED: That planning application K.16483 – Brew House Square, Royal Clarence Yard, Weevil Lane, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. That having regard to the provision of Section 54A of the Town and Country Planning Act 1990 and all other material considerations, a temporary building of this design and appearance is acceptable in this location. There will be no detrimental impact on the Conservation Area or nature conservation interests and no impact from a highway point of view. As such the development complies with Policies BE1, BE9, CH1, NC1 and T6 of the Gosport Borough Local Plan and Policies R/DP1, R/DP4, R/T11, R/BH2 and R/OS10 of the Gosport Borough Local Plan Review.

RESOLVED: That planning application K.16237/1 – 109 Privett Road, Gosport, be approved subject to the conditions set out in the report of the Regulatory Services Manager, for the following reason:
i. That having regard to the provisions of Section 54A of the Town and Country Planning Act 1990 and all other material considerations, the proposal does not have a detrimental impact on visual or residential amenity due to the orientation of the plot, the separation distances between dwellings and the design which respects the existing characteristics of the property. As such it compiles with Policies BE1 and BE3 of the Gosport Borough Local Plan and Policies R/DP1 and R/DP7 of the Gosport Borough Local Plan Review.
167. SUMMARY OF THE OFFICE OF FAIR TRADING REPORT ON THE REGULATION OF LICENSED TAXI AND PRIVATE HIRE VEHICLE SERVICES IN THE UK
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached in the Minute Book as Appendix "B"). The report summarised the recommendations of the Office of Fair Trading report on the regulation of licensed taxi and private hire vehicle services in the UK.
In accordance with Standing Orders, Mr Burnett was permitted to address the Board. Mr Burnett made the following points:
· There was no shortage of vehicles in Gosport, just drivers willing to use them. He knew of many who would travel to Fareham or Portsmouth for work because of the more relaxed regulations;
· In Gosport there is a lengthy and costly procedure for getting a licence which puts people off applying;
· A Working Group should be organised between the Council and Taxi Drivers to discuss these issues more regularly.
Members recognised that the procedure for getting a licence in Gosport was lengthy and costly, but that these measures had been put in place for the safety of Gosport residents.
RESOLVED: That –
i. The Regulatory Services Manager be requested to provide a further report to the Board following the Government's decision on whether to accept the recommendations of the Office of Fair Trading; and
ii. The Board agrees to defer any consideration of an "Unmet demand" survey until it has considered the above report.
168. TREE PRESERVATION ORDER G.110 – TREE ON LAND
ADJACENT TO 20 HURST GREEN, GOSPORT
Consideration was given to a report of the Borough Solicitor (a copy of which is attached in the Minute Book as Appendix "C") requesting the Board to consider whether to confirm, amend and confirm or not confirm Tree Preservation Order G.110.
RESOLVED: That Tree Preservation Order G.110 – Tree on Land Adjacent to 20 Hurst Green, Gosport, be confirmed.
