59. MINUTES
RESOLVED: That the Minutes of the Regulatory Board held on 17 June 2003 and the Extraordinary Regulatory Board held on 26 June 2003 be approved and signed by the Chairman as true and correct records.
60. DEPUTATIONS
It was reported that a deputation had been received relating to planning application K.8546/4 – Gosport BT Exchange, Stoke Road, Gosport.
61. INTERIM POLICY STATEMENT: MARINE PARADE AREA OF SPECIAL
CHARACTER – CONSULTATION DRAFT
Consideration was given to a report of the Director of Development and Environment (a copy of which is attached in the Minute Book as Appendix "A").
Members were informed that since the initial identification of an Area of Special Character for Marine Parade West and Marine Parade East at Lee-on-the-Solent in 1989 there continued to be a series of proposals for flatted development along the seafront. One of the original purposes of the Special Character Area was to try and retain a balance between more traditional development, principally in the form of detached houses and bungalows, and 3 and 4 storey flats. Further significant concern from Members and the Community regarding a number of recent proposals for flats has led to a review of the existing adopted Local Plan policy BE7 and deposit Local Plan Review policy R/DP10.
Following a detailed review of the character of development along both Marine Parade West and Marine Parade East, Officers have prepared this Interim Policy Statement and Supplementary Planning Guidance. The initial conclusion was that the Area of Special Character should be expanded to include the new Ross House in the west and to include the whole of Marine Parade East as far as its junction with Portsmouth Road. Further analysis indicated that the Area could be assessed in four distinct sections. The Interim Policy Statement discussed the character of these sections with particular reference to height, massing and setting of the existing buildings.
Two revised policies had been prepared to provide a planning policy framework to maintain the essential character of this area. The principal aims of the first policy will be to ensure that proposals for new development are well designed and relate to their surroundings. In particular it is essential that proposals have full regard to the height of existing development along the seafront and to the rear.
The second policy seeks to retain the commercial and leisure/recreational uses in Marine Parade which are popular with residents and visitors to Lee-on the-Solent and make an important contribution to the local economy.
Councillor Burgess was permitted to address the Board as Ward Councillor. Councillor Burgess made the following points:
- That the document was long overdue and welcomed by the Lee Councillors;
- That the document should also be used in other areas of Local Planning.
Members were informed that the Regulatory Board were unable to approve the Interim Policy as this fell outside the Boards Terms of Reference. However the Board could recommend that it is considered by the Development Plans Steering Group and forward the Board's comments on the Interim Policy to them. As with other policy and SPG documents the Council would be going out to consultation and as part of this process Members could make further comments.
RESOLVED: That the Regulatory Board recommends that the draft Marine Parade Area of Special Character – Interim Policy Statement, is considered by the Development Plans Steering Group and that the Development Plans Steering Group note that the Regulatory Board agrees with the principles set out in the document.
62. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "B").
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
63. K.16250 – ERECTION OF TWO STOREY REAR EXTENSION AND SINGLE STOREY SIDE EXTENSION

Members were informed that an informal site visit had taken place earlier in the day and that Councillors Clinton, Farr, Gill and Taylor had been present. At the Site Visit the following issues had been considered:
· The relevant position of the existing dwellings;
· The dividing boundary fence;
· Existing vegetation;
· The location of the lounge windows in 52 Manor Way.
RESOLVED: That planning application K.16250 – 50 Manor Way, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager.
64. K.13335/4 – OUTLINE APPLICATION – ERECTION OF DETACHED DWELLING AND ASSOCIATED CAR PARKING AREA (FRONTING ANGLESEY ARMS ROAD) (CONSERVATION AREA) (as amplified by letter dated 25.06.03)

65. K.13335/5 – CONSERVATION AREA APPLICATION – DEMOLITION OF EXISTING GARAGE, SHED AND PART BOUNDARY WALL (FRONTING ANGLESEY ARMS ROAD) (CONSERVATION AREA)

66. K.8546/4 – INSTALLATION OF 6no. SECTORED ANTENNAE, 1no. COMMUNICATION DISH, RADIO EQUIPMENT HOUSING AND ANCILLARY STRUCTURES (ADJACENT CONSERVATION AREA)
GOSPORT BT EXCHANGE, STOKE ROAD, GOSPORT
Officers informed members that further drawings had been requested of the applicant of the North Elevation. It was reported that the drawings already submitted were adequate, but that these further drawings had been requested to provide greater clarity. So far these drawings had not been received and the applicant had requested that the item be deferred until such time as the drawings had been provided.
Mr Rimington was permitted to address the Board on behalf of the objectors. Mr Rimington made the following points:
· That the current building was an eyesore, but that as it was originally Crown property and therefore exempt from planning procedure, nothing could have been done about it. Now the Board has an opportunity to correct matters;
· That the families to the east of Bury Road had spent a lot of time and money improving the Conservation Area and the additional phone masts would be detrimental to these improvements;
· That the verdict was still out on whether phone masts had a detrimental effect on those nearby, but that this should be researched fully before putting up new masts, especially given the close proximity the masts would have to schools, residential areas and retirement homes;
· Following the Council meeting on 9 July 2003 when the decision was made to ban further masts being stationed on Council Land within 500 metres of a school or residential property, that if this rule was good enough for Council Land then it should be good enough for the rest of the Borough.
Members questioned the appropriateness of the masts on health grounds and were informed that the applicant had provided a 'health and safety' compliance certificate (ICNIRP certification). Under the circumstances, Government planning guidance to local authorities suggested that it should not be necessary to consider further the health aspects and concerns about them. Discussion also took place regarding a deferment to wait for the further drawings of the North Elevation and a motion was proposed and seconded to defer the application until the drawings had been submitted.
RESOLVED: That planning application K.8546/4 – Gosport BT Exchange, Stoke Road, Gosport be deferred until the applicant provided drawings of the North Elevation.
67. K.7052/5 – ERECTION OF TWO STOREY DETACHED DWELLING AND CAR PARKING (as amplified by letter dated 30.06.03)

RESOLVED: That planning application K.7052/5 – Land Adjacent to 144 Clayhall Road, Gosport be refused for the reason set out in the report of the Regulatory Services Manager.
68. K.16360 – DETAILS PURSUANT TO K.15000/1 – ERECTION OF 40no. DWELLINGS (PHASE 3C – PLOTS 907-946)

RESOLVED: That planning application K.16360 – Land East of Cherque Farm, Lee-on-the-Solent be approved pursuant to Additional Condition 01 (e, f and i) (in parts) attached to Outline Planning Consent, reference K.15000/1, relating to this defined phase of the development only and subject to the conditions set out in the report of the Regulatory Services Manager.
69. K.1863/4 – SITING OF SINGLE STOREY MODULAR BUILDING FOR USE AS CHURCH MEETING ROOMS (as amended by letter dated 25.06.03)

70. K.15833/4 – ERECTION OF 2no. INDUSTRIAL BUILDINGS (D1 & D4) ASSOCIATED ACCESS AND PARKING OFF HERITAGE WAY (as amended by letter dated 01.07.03 and plans received 02.07.03)

71. K.3629/2 – ERECTION OF TWO STOREY SIDE AND SINGLE STOREY FRONT SIDE AND REAR EXTENSIONS
19 SWANAGE ROAD, LEE-ON-THE-SOLENT
Members were informed that three further letters of objection with attachments had been received since the publishing of the report and that they were available for inspection in the circulated Letters of Objection file. It was reported that the letters were concerned that the site was being used for business purposes and that additional parking spaces had been requested. Reference was made to previous letters of objection from the neighbour at 21 Swanage Road listing a number of grievances, but that Officers had contacted this person and they confirmed they had no complaints regarding the currant proposal. Members were informed that Officers had continually monitored the situation regarding the premises being used for business purposes and that no evidence had been found to support this claim or that a material change in use of the property had taken place. Members were also informed that no additional parking was proposed in excess of that indicated of the previous approved scheme ref: K.3629/1.
Concern was raised by Members about the level and insistence of the claims that the property was being used for business purposes, and were informed that Officers would continue to monitor the situation. The Borough Solicitor advised that the application for this development could be dealt with by Members, and that the question of any possible business use could be dealt with in the future should further allegations be brought forward.
RESOLVED: That planning application K.3629/2 – 19 Swanage Road, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager.
72. K.A1336 – ERECTION AND DISPLAY OF NON-ILLUMINATED THREE PANEL SIGN BOARD (PHASE 2C)

74. K.16371 – GPD PART 24 CONSULTATION – ERECTION OF 15M. HIGH SLIMLINE MONOPOLE TELECOMMUNICATIONS MAST WITH ANTENNA AND EQUIPMENT CABINETS
LAND AT ROWNER ROAD, GOSPORT
Members were informed that it had been necessary to prepare this report in advance of the expiry of the consultation period because of the timing of the submission and the legal requirement to determine the proposal within eight weeks of submission. It was reported that this period expires on 11 August 2003, one day before the next available meeting of the Regulatory Board. Therefore, it was necessary for the Board to determine what should be done in any eventuality.
RESOLVED: That –
a) Subject to no objections being received as a result of the public advertisement and school consultation process (expires 22.07.03), Grant 'prior approval' for the siting and appearance of the installation.
b) In the event that objection is received during the consultation period (expires 22.07.03), delegated authority be given to the Regulatory Services Manager, in consultation with the Chair of the Regulatory Board, for the determination of this Part 24 Consultation.
75. EXCLUSION OF PRESS AND PUBLIC
RESOLVED: That under Section 100(A) (4) of the Local Government Act 1972, the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined by paragraph 7 of Part 1 of Schedule 12(A) of the Act.
76. APPLICATION FOR A PRIVATE HIRE VEHICLE DRIVERS LICENCE
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached to the Minute Book as Appendix "C") advising the Board of an application for a Private Hire Vehicle Driver's Licence. Members were informed that following a Criminal Records Bureau check, relevant offences had been identified applicable to the consideration of the licensing process.
RESOLVED: that the application for a Private Hire Vehicles Drivers license be refused on the grounds that the Regulatory Board members did not consider the applicant to be a fit and proper person due to relevant past criminal offences.
