[It was reported, that in accordance with Standing Orders, Councillor Edwards had been nominated to replace Councillor Gill for the meeting].
77. MINUTES
RESOLVED: That the Minutes of the Regulatory Board held on 15 July 2003 be approved and signed by the Chairman as a true and correct record.
78. DEPUTATIONS
It was reported that a deputation had been received relating to planning application K.14898/1 – Land North of 24 Carlton Road, Gosport.
79. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "A").
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
80. K.16400 – DETAILS TO K.15000/1 – ERECTION OF 27no. DWELLINGS (PHASE 4C – PLOTS 848-874) (as amplified by letter dated 10.07.03)
LAND EAST OF CHERQUE FARM, LEE-ON-THE-SOLENT
RESOLVED: That planning application K.16400 – Land East of Cherque Farm, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager.
81. K.16376 – CONVERSION OF EXISTING DWELLING TO FORM THREE FLATS, SINGLE STOREY REAR EXTENSION AND EXTERNAL ALTERATIONS (as amended by letter dated 21.07.03)
7 VICTORIA STREET, GOSPORT
Members raised concern about the parking provision at the site and a petition was handed in on this matter from the residents of Victoria Road requesting the removal of pinch ponts to increase the amount of on street parking. Concerns were also raised by Members about the level of refuse created at the site.
It was proposed and seconded that a site visit should take place to clarify the matters of parking and site refuse.
RESOLVED: That outline application K.16376 – 7 Victoria Street, Gosport be deferred pending a site visit to be held prior to the next meeting of the Regulatory Board.
82. K.5322/10 – COUNTY CONSULTATION – REGULATION 3 – RENEWAL OF CONSENT FOR SITING OF 1no. DOUBLE AND 1no. SINGLE TEMPORARY CLASSROOM BUILDINGS
GRANGE INFANT SCHOOL, FRANKLIN ROAD, GOSPORT
Concern was raised by Members about the length of time these temporary classroom buildings had been in position. Members were informed that this application was a matter for the County Planning Authority to determine, but that the officer recommendation sought to influence this by limiting the proposed consent to a period of one year rather than the four year term being requested by the County Education Department. It was decided that a letter be written by Officers requesting that the County Regulatory Committee take into consideration the concerns of the Regulatory Board regarding the time period for these temporary buildings.
RESOLVED: That no objection be raised to the county consultation – Regulation 3 planning application K.5322/10 – Grange Infant School, Franklin Road, Gosport for a limited period only expiring 31.08.04 and subject to the conditions set out in the report of the Regulatory Services Manager.
83. K.15833/5 – ERECTION OF BUILDING (E1) FOR MOTOR CAR DISTRIBUTOR WITH ASSOCIATED ACCESS AND PARKING OFF HERITAGE WAY (as amplified by plans received 25.07.03)
LAND ADJACENT FORT BROCKHURST, HERITAGE WAY, GOSPORT
Members were informed that letters had been received amplifying the proposal dated 15.07.03 and 28.07.03, and that amended plans had been received dated 25.07.03. It was also reported that a letter from English Nature had been received with a holding objection but that they had agreed to withdraw the objection subject to the following alteration to the proposed condition 9 relating to badger mitigation:
9. No construction works above ground level pursuant to this permission shall commence until measures have been implemented for the protection of badgers in accordance with a scheme of mitigation submitted to and approved by the Local Planning Authority in writing.
Reason:
In the interest of wildlife conservation and to comply with policy NC2 of the Gosport Borough Local Plan.
RESOLVED: That planning application K.15833/5 – Land Adjacent Fort Brockhurst, Heritage Way, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager and the amendment to condition 9 as set out above.
84. K.16300/1 – ERECTION OF 4no. 15 METRE HIGH FLOODLIGHTING COLUMNS FOR MULTIUSE SPORTS PLAYGROUND AREA
SISKIN JUNIOR SCHOOL, NIMROD DRIVE, GOSPORT
Members were informed that no response had been received from the independent lighting consultant referred to in paragraph 5.2. It was therefore necessary to add an extra condition stating that permission be granted subject to the receipt of amended drawings relating to lantern fixing detail.
RESOLVED: That planning application K.16300/1 – Siskin Junior School, Nimrod Drive, Gosport be approved subject to the receipt of amended drawings relating to lantern fixing detail, the development beginning within a period of five years starting from 12.08.03 to comply with Section 91 of the Town and Country Planning Act, 1990 and subject to the conditions set out in the report of the Regulatory Services Manager.
85. K.14898/1 – ERECTION OF 1no. DETACHED HOUSE IN NICHOLSON GARDENS. RELIEF FROM STANDARD CONDITION A OF K.14898 REQUIRING COMMENCEMENT WITHIN 5 YEARS OF PERMISSION (CONSERVATION AREA) (as amended by letter dated 25.07.03 and by plans received 28.07.03)
LAND NORTH OF 24 CARLTON ROAD, GOSPORT
Mr Hayward was permitted to address the Board on behalf of the objectors. Mr Hayward made the following points:
· That he canvassed the residents of Carlton Road last night and that the vast majority of residents were opposed to the development.
· That a site visit should be held and the item deferred to allow Members to get an accurate assessment of the site and a more comprehensive survey of the local resident's views.
· That it was the understanding of local residents that the lady who bequeathed the garden to the United Reform Church did so on the understanding that it would be a garden to be used by the community for functions such as fetes and as a memorial garden.
· A great deal of the gardens flora would be destroyed, including an Edwardian rose bed.
Members were informed that the application had not changed since September 1998 and that there was no new material consideration regarding the site. Members felt, however, that a site visit would enable them to assess the points raised by Mt Hayward.
It was proposed and seconded that a site visit should take place.
RESOLVED: That planning application K.14898/1 – Land North of 24 Carlton Road, Gosport be deferred pending a site visit to be held prior to the next meeting of the Regulatory Board.
86. TREE PRESERVATION ORDER G106 – 11 TREES IN GOSPORT HIGH STREET
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached to the Minute Book as Appendix "B"). Members were informed that paragraph 3.2 should read as follows:
3.2 confirm the TPO without modification, the effect of this is that the TPO continues in effect, this protects the trees concerned by making it an offence to damage or fell them subject to certain exceptions. The exceptions are that the tree concerned was dead, dying or dangerous, or that the tree is a highway tree that is removed by the relevant highway authority on safety grounds.
Members felt that as the trees in question are expected to form part of the consultant's consideration of the improvement scheme for the High Street, it would make sense to follow the recommendation outlined in paragraph 3.2.
RESOLVED: That the provisional Tree Preservation Order on 11 trees in Gosport High Street be confirmed without modification.
