The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "A").

222. K.10682/1 – PROVISION OF NEW BERTH FOR GOSPORT FERRY AND REPLACEMENT OF EXISTING QUAY WALL (as amended by plans and letter received 21.02.03)

Members were informed that a letter had been received from the Environment Agency and that two new conditions were to be added to the report relating to flood defences and pollution. Members were also informed that the applicants had been consulted and were happy with their inclusions.
The additional conditions were:
- A scheme for the maintenance and repair of the quay wall shall be submitted to and approved by the Local Planning Authority before the works hereby permitted commence.
Reason
To ensure the structural integrity of the flood defences is maintained and to comply with policy BE1 of the Gosport Borough Local Plan
- Any facilities for the storage of fuels and chemicals shall be sited on impervious bases and surrounded by impervious bund walls, details of which shall be submitted to the Local Planning Authority for approval. The volume of the bunded compound should be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage the compound should be at least equivalent to 110% of the largest tank or 25% of the total combined capacity of the interconnected tanks whichever is the greater. All filling points, vents, gauges and sight glasses shall be located within the bund. The drainage system of the bund shall be sealed with no discharge to any watercourse land or underground strata. Associated pipework shall be located above ground and protected from accidental damage. All filling points and tank overflow pipe outlets should be detailed to discharge downwards into the bund.
Reason
To prevent pollution of the water environment and to comply with policies BE1 and IMP3 of the Gosport Borough Local Plan.
RESOLVED: That planning application K.10682/1 – Clarence Wharf, Mumby Road, Gosport be approved subject to the conditions set out above and in the report of the Regulatory Services Manager.

Members were informed that one letter of objection had been received but that it was covered in the report.
Members expressed concern at the way the conservatory related to the existing roof of the dwelling.
A motion was proposed and seconded that the item be deferred for further negotiation on its design. The motion was supported.
RESOLVED: That planning application K.16237 – 109 Privett Road, Gosport be deferred to negotiate an improved design.

By reason of urgency, the Chairman determined that this item (a copy of which is attached in the Minute Book as Appendix "B") be considered at this meeting notwithstanding the fact that the item had not been available for public inspection in accordance with the provisions of Section 100B(4)(a) of the Local Government (Access to Information) Act 1985. The special circumstances were that the building work on the site had begun before the Section 106 Agreement agreed at the November meeting of the Regulatory Board had been signed. 'The description of the development and the conditions required modifications to take account of the work that had been done on site. Members' attention was drawn to the alterations highlighted in bold print.
RESOLVED: That:-
i. amended planning application K.15660/5 – St George Barracks (South), Mumby Road, Gosport be approved subject to the satisfactory completion of an Agreement under Section 106 of the Town and County Planning Acts relating to the provision of affordable housing, the payment of a commuted sum towards the provision and/or improvement of outdoor playing space, the funding of Traffic Regulation Orders and provision of the community offices; the satisfactory completion of an amended Agreement under Section 278 of the Highways Act relating to the payment of a contribution towards improving accessibility for alternative modes of transport; and subject to the revised conditions; and
ii. that the Head of Development Control in consultation with the Borough Solicitor be given authority to revise the wording of a number of conditions to provide that development is in accordance with the details provided.

i. amended listed building application K.15660/6 – St George Barracks (South), Mumby Road, Gosport be approved subject to the revised conditions; and
ii. that the Head of Development Control in consultation with the Borough Solicitor be given authority to revise the wording of a number of conditions provided that development was in accordance with the details provided.
Members expressed thanks to the Planning Officers who had worked extremely hard and quickly to prepare the amendments.
232. EXCLUSION OF THE PUBLIC
RESOLVED: That under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in Paragraph 4 of Part 1 of Schedule 12(A) of the Act.
233. APPLICATION FOR A PRIVATE HIRE VEHICLE DRIVERS LICENCE
Consideration was given to an exempt report of the Regulatory Services Manager (a copy of which is inserted in the Minute Book as Appendix "D") in connection with an application for a Private Hire Vehicle Drivers Licence.
RESOLVED: That the application for a Private Hire Vehicle Drivers Licence be refused on the grounds of suitability.
234. REVIEW OF THE HACKNEY CARRIAGE AND PRIVATE HIRE
VEHICLE DRIVERS LICENCES HELD BY AN INDIVIDUAL
(Councillor Carr declared a personal interest with regard to the above application in view of his acquaintance with the applicant, left the meeting prior to its consideration and did not take part in the discussion or voting thereon.)
Consideration was given to an exempt report of the Regulatory Services Manager (a copy of which is inserted in the Minute Book as Appendix "E") in connection with the review of a Hackney Carriage and Private Hire Vehicle Drivers Licence held by an individual.
Members were handed information relevant to the case by the individual and decided to continue with the item. The individual was happy for the Board to continue and wished to add nothing further to his case.
RESOLVED: That the Hackney Carriage and Private Hire Vehicle Drivers Licence be suspended until the medical issues were resolved.
