192. MINUTES
RESOLVED: That the Minutes of the meeting of the Regulatory Board held on 28 January 2003 be approved and signed by the Chairman as a true and correct record.
193. DEPUTATIONS
It was reported that deputations had been received relating to planning applications K.16200 – Land at rear of 14 Grove Road, Gosport, K.15857 HMS Daedalus, Lee-on-the-Solent and K.5329/6 – Gosport Park, Park Road, Gosport.
194. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "A").
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
195. K.16200 – OUTLINE APPLICATION – ERECTION OF DETACHED BUNGALOW (as amplified by letter dated 13.12.02)
LAND AT REAR OF 14 GROVE ROAD, GOSPORT
(Councillor Hayward gave his apologies for his inability to attend the site visit, and stated that as such he felt he could not contribute to the Boards decision.)
Members were informed that following the site visit, it was important that they still considered the application in terms of access and sitting, and decide whether they were appropriate for a dwelling.
Mr Norton was permitted to address the Board as the applicant. Mr Norton:
· thanked the Board for visiting the site but stated that he had no comments to add to his presentation from the last Board meeting.
Members enquired after clarification on the access site, and were informed that although the site was large, the access would be achieved through a Council parking courtyard and rear service road and therefore, the access was not felt to be appropriate for this site. A concern was also raised that a precedent would be set if planning permission was granted.
RESOLVED: That outline planning application K.16200 – Land at rear of 14 Grove Road, Gosport be refused for the reasons set out in the report of the Regulatory Services Manager.
196. K.15857 – OUTLINE APPLICATION – ERECTION OF 300
UNITS TO PROVIDE OFFICERS AND OTHER RANKS
MARRIED QUARTERS: PHASE 1 TO COMPRISE 148 UNITS
AND PHASE 2 TO COMPRISE 152 UNITS (AREA 6) (as
amended by plans received 12.07.02 and 28.01.03 and
amended and amplified by letters dated 09.07.02, 29.07.02,
11.12.02 and 24.01.03
HMS DAEDALUS, LEE-ON-THE-SOLENT
Members were informed that Phase 1 would comprise 148 Units not 184 Units as stated on the first page of the report and that on page 5 of the report paragraph 1.3 should read:
1.3 The site is bounded to the south by residential development off Manor Way, to the west and north by the remainder of the site and the airfield and to the east by the adjoining allotments and Broom Way.
Mr McFarland of Turley Associates was permitted to address the Board on behalf of the applicants. Mr McFarland made the following points:
· That extensive dialogue had taken place between themselves and the Planning Officers and that the outcome was an improved development proposal;
· that the proposed development would be of benefit to all;
· Phase 1 would be for personnel already living in the area and for those at HMS Collingwood in Fareham and Phase 2 would be for personnel being relocated to the area;
· the plans were a good example of reuse of a Brown Field Site;
· the dwelling density was in line with the Government's outline of 30 per hectare;
· that much open space, areas of play and tree retention had been incorporated into the plans;
· that 500 dwellings were originally outlined as being needed so 300 was well within the initial figure;
· the plans were in accordance with the Local Plan and Government guidelines and should be supported.
Members expressed concern about how the latest press releases affected the applicants desire to proceed but Mr McFarland replied he had no instruction from his employers on this matter, and that the need for personnel housing still remained.
Councillor Burgess, as Ward Councillor, was permitted to address the Board. Councillor Burgess made the following points:
- that following the news on Friday about Asylum Seekers being based at HMS Daedalus, the implications for the site would need to be reviewed as the report was written before this announcement;
- that a decision should be deferred until further information could be gathered and the implications became clearer.
Members expressed concern about the news relating to Asylum Seekers at HMS Daedalus and whether a deferment could be made. They were informed that the application was an outline application and that the recent news stories had no relevance to the case. A concern was also raised that of the 300 dwellings to be erected, not one would be available for Gosport's housing problems.
A request was made and seconded to defer the item until further information about Asylum Seekers at HMS Daedalus and the possible implications they would have could be gathered.
A vote was taken and the outcome of which was that the request was refused.
RESOLVED: That outline planning application K.15857 – HMS Daedalus, Lee-on-the-Solent be approved subject to the satisfactory completion of an Agreement under Section 106 of the Town and Country Planning Act 1990 relating to the provision of affordable housing, the payment of a commuted sum towards the provision and/or improvement of outdoor playing space, the payment of contributions towards education facilities required to serve the development, the payment of a contribution towards off site transport improvements and subject to the conditions set out in the report of the Regulatory Services Manager.
197. K.16217 – REGULATION 3 – WIDENING OF EXISTING FOOTPATH AND CONVERSION TO SHARED USE CYCLETRACK, INCLUDING PROVISION OF STREET LIGHTING (SOUTH OF LINDEN GROVE)
ANGLESEY GARDENS, ANGLESEY ROAD, GOSPORT
RESOLVED: That planning application K.16217 – Anglesey Gardens, Anglesey Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager.
198. K.5329/6 – REGULATION 3 – DEMOLITION OF EXISTING PAVILLION AND ERECTION OF TWO STOREY/SINGLE STOREY RUGBY PAVILLION (CONSERVATION AREA) (as amended by plans and information received 29/01/03)

(Councillor Cully declared a personal interest as he lived in the adjacent residential development, left the meeting prior to its consideration and did not take part in the discussion or voting thereon.)
Members were informed that two further letters of objection had been received and one petition of objection containing 33 signatures. Members were informed that they raised the following issues:
- Parking
- Loss of variety of sporting provision
- Loss of view
- Increase in intensity of use
- Size of pavillion
Members were informed that parking was not an issue as the hectarage of the playing fields decided the parking provision and that was not to be increased. The pavillion was to be used for both rugby and cricket so would be in dual use. The intensity of use would not increase, as the revised plans did not include the initially proposed gymnasium. Members were also informed that facilities were not significantly increased.
Mr Monaghan, Chairman of Gosport & Fareham RFC Mini/Youth Section was permitted to address the Board on behalf of the applicants. Mr Monaghan made the following points:
- The objections about parking should not be considered as the new plans actually included an increase of 40 parking spaces;
- during match-days and functions they consulted with the Police and the Council about parking and tried to marshal the roads nearby as much as possible;
- the new pavillion would be a Community Centre and focal point for the local residents;
- that if the plans were rejected then it would be a lost opportunity to Gosport and Fareham.
Members asked Mr Monaghan whether there was a time limit on the grant they had been awarded to refurbish the pavillion. They were informed that the grant was only valid until 14 April 2003 at which point it became worthless and the bidding would have to begin again.
Councillor Redrup, as Ward Councillor, was permitted to address the Board. Councillor Redrup circulated photographs of parking on match days and made the following points:
- That he had been asked by Dolphin Residents Association to present objections to the plans;
- that he had personally witnessed the parking chaos on match days;
- should the club's expansion continue, and bigger games and opposition be played, what then?
- Despite the Club's claims, Rowner Cricket Club would not be moving to Gosport Park;
- the use of the site for other functions would raise antisocial behaviour issues and should be taken into consideration.
Members asked the Officers about the provision for parking, and were informed that as a Council Park, it more than met the requirement for parking.
RESOLVED: That planning application K.5329/6 – Gosport Park, Park Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager.
199. K.16197 – CHANGE OF USE TO BOAT CHANDLERY (LISTED BUILDING IN CONSERVATION AREA) (as amended by plans received 22.01.03)

Members were informed that one letter of clarification had been received from the applicant in which he explained that the porch needed to be slightly bigger than outlined in the Local Plan because his son required wheelchair access.

210. K.14311/1 – ERECTION OF TWO STOREY REAR EXTENSION
10 SCHOOL ROAD, GOSPORT
Members were informed that the following paragraphs of the report should read as follows:
1.1 The application site is located on the east side of School Road. The property is an end of terrace house, which has an access path to the rear garden along the side of the property and adjacent to number 12.
1.2 The proposal is for a two-storey extension to the rear of the property. The extension projects 2.7 metres from the rear elevation and extends the full width of the property. The proposal has a hip roof design to match the existing roof of the dwelling. It is also proposed to have one window at first floor level on the north boundary.
5.2 The existing dwelling casts some shadow on the neighbouring property of number 12 for much of the day because they are east facing. In my opinion the addition of this modest two-storey extension to the rear would not increase the shadowing to an unacceptable level and therefore there would be no significant loss of light. The window on the north boundary overlooks the neighbouring property. However, as this is a bathroom window I consider a condition that this window is obscure glazed would overcome any harm.
RESOLVED: That planning application K.14311/1 – 10 School Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager.
211. EXCLUSION OF THE PUBLIC
RESOLVED: That under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 4 of Part 1 of Schedule 12(A) of the Act.
212. APPLICATION FOR A DOOR SECURITY REGISTRATION

Consideration was given to an exempt report of the Director of Development and Environment (a copy of which is inserted in the Minute Book as Appendix "B") in connection with an application for a Door Security Registration.
RESOLVED: That the application for a Door Security Registration be approved subject to the individual attending a further Door Security Operatives course.
213. APPLICATION FOR A PRIVATE HIRE VEHICLE DRIVERS LICENCE
