[It was reported, that in accordance with Standing Orders, Councillor Chegwyn had been nominated to replace Councillor Carr for the meeting].
 
 
87.      APOLOGIES
 
Apologies for inability to attend the meeting were submitted on behalf of Councillors Carr, Cully and Mrs Elshaw.
 
88.      MINUTES
 
RESOLVED: That the Minutes of the Regulatory Board held on 12 August 2003 be approved and signed by the Chairman as a true and correct record.
 
89.      DEPUTATIONS
 
It was reported that deputations had been received relating to planning applications K.8546/4 – Gosport BT Exchange, Stoke Road, Gosport and K.15750/2 – Land Adjacent to Powder Pier Heritage Area, Priddy's Hard, Gosport.
 
90.     REPORTS OF THE REGULATORY SERVICES MANAGER
 
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "A").
 
RESOLVED: That decisions be taken on each application for planning consent as detailed below:
 
91.      K.14898/1 – ERECTION OF 1no. DETACHED HOUSE IN NICHOLSON GARDENS. RELIEF FROM STANDARD CONDITION A OF K.14898 REQUIRING COMMENCEMENT WITHIN 5 YEARS OF PERMISSION (CONSERVATION AREA) (as amended by letter dated 25.07.03 and plans received 28.07.03)
LAND NORTH OF 24 CARLTON ROAD, GOSPORT
 
Members were informed that an informal site visit had taken place earlier in the day and that Councillors Carr, Chegwyn, Clinton, Farr, Gill and Smith had been present. At the Site Visit the issues raised at the previous meeting were considered.
 
RESOLVED: That planning application K.14898/1 – Land North of 24 Carlton Road, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager.
 
92.      K.16376 – CONVERSION OF EXISTING DWELLING TO FORM THREE FLATS, SINGLE STOREY REAR EXTENSION AND EXTERNAL ALTERATIONS (as amended by letter dated 21.07.03)

Members were informed that an informal site visit had taken place earlier in the day and that Councillors Carr, Chegwyn, Clinton, Farr, Gill, Searle and Smith had been present. At the Site Visit the issues raised at the previous meeting were considered.
 
RESOLVED: That outline application K.16376 – 7 Victoria Street, Gosport be approved subject to the satisfactory completion of a Section 106 Agreement of the Town and Country Planning Act 1990 relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager.
 
93.      K.8546/4 – INSTALLATION OF 6no. SECTORED ANTENNAE, 1no. COMMUNICATION DISH, RADIO EQUIPMENT HOUSING AND ANCILLARY STRUCTURES (ADJACENT TO CONSERVATION AREA) (as amplified by plans received 18.08.03)
GOSPORT BT EXCHANGE, STOKE ROAD, GOSPORT
 
It was reported to the Board that the plans received were inaccurate and that the item should be withdrawn from the agenda. Members agreed that further consideration of the application should be deferred until correct plans had been submitted.
 
94.      K.15750/2 – CONVERSION OF EXISTING SUB-STATION BUILDING TO 4no. TOWN HOUSES AND ERECTION OF SINGLE STOREY GARAGE/STORES BUILDING (CONSERVATION AREA) (as amplified by information received 14.08.03, 20.08.03 and 26.08.03 and amended by letter dated 13.08.03 and plans received 14.08.03)
LAND ADJACENT TO POWDER PIER HERITAGE AREA, PRIDDY'S HARD, GOSPORT
 
Members were informed that the recommendation had been amended to include the payment of a commuted sum towards the clearance and maintenance of the adjacent land in order to improve the setting of the building and in the interests of the amenity of future occupiers and that an additional condition was proposed regarding the former acid store building:
 
12. The former acid store (building 437/322) shall be demolished to ground level and the resultant materials from the land before the development is first brought into use.
Reason
In the interests of the visual amenity of the locality and to comply with policies BE1 and BE9 of the Local Plan.
 
Members were also informed that one further letter of objection had been received expressing the view that there should be public access to Powder Pier. Members were advised that access to the pier was not under the control of the applicant and that English Nature wished access to be restricted in the interests of nature conservation.
 
Mr Underwood was permitted to address the Board on behalf of the applicants. Mr Underwood made the following points:
 
·        That as the entrance to the Heritage Area, the site was very important;
·        The plans proposed a development that maximised the use of the land;
·        The plans were drawn-up using the original building footprints, thereby ensuring minimum impact on the area;
·        That the balconies didn't interfere with the monument and were there to create some private open space.
 
It was noted that the issue of clearance and subsequent maintenance created by the balconies was covered by the amended recommendation shown below.
 
RESOLVED: That planning application K.15750/2 – Land Adjacent to Powder Pier Heritage Area, Priddy's Hard, Gosport be approved subject to the satisfactory completion of an Agreement under the provisions of Section 106 of the Town and Country Planning Act 1990 relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and the payment of a commuted sum towards the clearance and subsequent maintenance of the adjacent land and subject to the conditions set out in the report of the Regulatory Services Manager and condition 12 above.
 
95.      K.15396/3 – DETAILS PURSUANT TO K.15396/2 – ERECTION OF DETACHED DWELLING WITH DOUBLE GARAGE (CONSERVATION AREA) (as amplified and amended by letter dated 08.08.03)

(Councillor Gill declared a personal interest with regard to the above application, left the meeting prior to its consideration and did not take part in the discussion or voting thereon.)
 
RESOLVED: That planning application K.15396/3 – Land Adjoining 2 Dolphin House, Green Lane, Alverstoke, Gosport be approved subject to the conditions set out in the report of the Regulatory Services Manager.
 
96.      K.16321/1 – ERECTION OF BLOCK OF 7no. FLATS WITH ASSOCIATED CAR PARKING AND LANDSCAPING (as amplified by letter dated 14.08.03 and plans received 18.08.03)
LAND ADJACENT TO 88 ST VINCENT ROAD, GOSPORT
 
Members were informed of an additional condition to be added to the application relating to parking provision:
 
09. Before any building operation above ground level is commenced, details of a scheme for the parking and manoeuvring of vehicles within the land hatched green on the approved plan shall be submitted to, and approved by, the Local Planning Authority. The approved scheme shall be completed before the development is first brought into use and shall be retained and kept available for these purposes at all times.
Reason
In the interests of visual amenity and highway safety and to ensure adequate car parking is provided and retained, and to comply with Policies BE1 and T6 of the Local Plan.
 
RESOLVED: That planning application K.16321/1 – Land Adjacent to 88 St Vincent Road, Gosport be approved subject to the developer entering into a planning obligation under Section 106 of the Town and Country Planning Act 1990 as approved by the Council relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager and condition 09 above.
 
97.      K.16348 – ERECTION OF DETACHED DWELLING WITH INTEGRAL GARAGE (as amplified by letters dated 22.07.03, 07.08.03 and 18.08.03 and amended plans received 19.08.03)
LAND ADJOINING 77 WESTERN WAY, GOSPORT
 
RESOLVED: That planning application K.16348 – Land Adjoining 77 Western Way, Gosport be approved subject to the satisfactory completion of a Section 106 Agreement of the Town and Country Planning Act 1990 relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager.
 
98.      K.16410 – CHANGE OF USE FROM RETAIL SHOP (CLASS A1) TO MORTGAGE CONSULTANTS (CLASS A2)

99.      K.16295 – OUTLINE APPLICATION – ERECTION OF SINGLE STOREY BUNGALOW (as amplified by letter dated 30.07.03)
LIGHT MACHINE REPAIRS, NORMAN ROAD, GOSPORT
 
RESOLVED: That planning application K.16295 – Light Machine Repairs, Norman Road, Gosport subject to the developer entering into a planning obligation under Section 106 Agreement of the Town and Country Planning Act 1990 as approved by the Council relating to the payment of a commuted sum towards the provision and/or improvement of outdoor playing space and subject to the conditions set out in the report of the Regulatory Services Manager.
 
100.    EXCLUSION OF PRESS AND PUBLIC
 
RESOLVED: That under Section 100(A) (4) of the Local Government Act 1972, the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined by paragraph 7 of Part 1 of Schedule 12(A) of the Act.
 
101.    APPLICATION FOR A PRIVATE HIRE VEHICLE DRIVERS LICENCE
 
Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached to the Minute Book as Appendix "B") advising the Board of an application for a Private Hire Vehicle Driver's Licence. Members were informed that following a Criminal Records Bureau check, relevant offences had been identified applicable to the consideration of the licensing process.
 
RESOLVED: that the application for a Private Hire Vehicles Drivers license be refused on the grounds that the Regulatory Board members did not consider the applicant to be a fit and proper person due to relevant past criminal offences.
