(It was reported that, in accordance with Standing Orders, Councillor Redrup had been nominated to replace Councillor Mrs Angus for the meeting).
102. APOLOGIES
An apology for inability to attend the meeting was submitted on behalf of Councillor Mrs Angus.
103. MINUTES
RESOLVED: That the Minutes of the Regulatory Board held on 9 September 2003 be approved and signed by the Chairman as a true and correct record subject to it being recorded that Councillor Gill had attended the meeting although it had not been shown in the minutes.
104. FINANCIAL YEAR END UPDATE ON THE BUILDING CONTROL PARTNERSHIP
Consideration was given to a report of the Director of Development and Environment (a copy of which is attached to the Minute Book as Appendix "A").
Members were advised that following the formal signing of the legal agreement between Gosport Borough Council and Fareham Borough Council in October 2002, the Building Control Services of the respective councils began working together as a single unit from 1 February 2003. The administration centre for The Building Control Partnership had been established at Fareham Civic Offices with a surveying and reception presence maintained at Gosport. All documentation and stationery now reflected the Partnership, and the Ocella computerised system, already in use at Fareham Borough Council, had been implemented for processing all Partnership Building Regulation applications. Remote access links between the two office locations had been established and initial teething problems of various kinds were being resolved. All external subscription services, such as quality assurance registration, which were previously individually supplied, had now been consolidated into a single partnership account with the anticipated savings in fees being realised.
It was reported that the establishment of the Building Control Partnership represented a nation first and had generated significant interest from other groups of authorities considering this option for Building Control. Members were advised that the savings identified in the Partnership agreement had either been fully realised or would be achieved when relevant existing service contracts were renewed. It was also noted that the surplus generated in the first two months of the Partnership exceeded that projected. It was reported that the Partnership management panel consisting of Councillor K Searle (Gosport Borough Council), Councillor A Mandry (Fareham Borough Council), together with officer representation from both Authorities had met quarterly with the first of these meetings being held on 18 March 2003. It was reported that good working relationships had been developed between Members and Officers. The Board were also informed that to date, the legal agreement appeared to be robust and had proved to be a good reference document. Members were advised that the recruitment and retention of sufficient effective staff establishment remained crucial to the successful delivery of Partnership services. The establishment of the Partnership in itself represented a considerable achievement considering the stalling or failure of a number of similar proposals elsewhere in the country. The first two months of operation of the Partnership had produced favourable customer feedback, new contracts, closer working arrangements and understanding between Fareham and Gosport Borough Councils, together with positive financial results.
RESOLVED: That the report of the Director of Development and Environment be noted.

Consideration was given to a report of the Regulatory Services Manager (a copy of which is attached to the Minute Book as Appendix "B").
Members were informed that Application K12345/68 had been considered by the Regulatory Board at the meeting held on 13 August 2002. The Board resolved to grant planning permission subject to the prior completion of an agreement under Section 106 of the Town and Country Planning Act 1990 relating to off-site highway works including improvements to pedestrian, cycle and public transport facilities. It was reported to the Board that work on the access road was about to commence, but that, the Section 106 Agreement had not yet been completed so the planning permission had not yet been issued. In addition there were conditions, which required details to be submitted before development commenced. This meant that any works that might take place on the site before the permission was issued and the 'before commencement' conditions were discharged would not have the benefit of planning permission and any development that had taken place would not be regularised by the issue of the decision notice as originally drafted. Furthermore the conditions as approved did not allow for the continuation of the existing uses on the site on a lawful basis. Members were therefore informed that it was necessary to revise the description of the development and amend the wording of the conditions to reflect these circumstances.
Members were advised that proposed schedule 3 (formerly 4) of conditions as contained in the report had been amended. The fifth line should contain the words "to be" between "scheme" and "submitted".
RESOLVED: That the amended description and conditions set out in the report be approved.
106. REPORTS OF THE REGULATORY SERVICES MANAGER
The Regulatory Services Manager submitted a report on applications received for planning consent setting out the recommendations in each case (a copy of which is attached in the Minute Book as Appendix "C").

107. K.16430 – CHANGE OF USE FROM DWELLING HOUSE (CLASS C3) TO BED AND BREAKFAST ACCOMMODATION (CLASS C1) (5 LETTING ROOMS) (as amplified by letter dated 12.08.03 and e-mail dated 31.08.03 and by plans received 22.09.03)
41 MILVIL ROAD, LEE-ON-THE-SOLENT
Members were updated on objections received from Lee-on-the –Solent Residents Association on the grounds that the proposal did not comply with Policy H10 of the Gosport Borough Local Plan. Two letters had also been received from the applicant, one of which indicated a willingness to accept personal planning permission. The other letter, addressed to the Board, related to planning issues.
Concern was expressed about the fact that the owner would be non-resident, together with safety issues relating to the use of the roof area. It was concluded that these issues were under the control of other agencies and were not related to planning.
RESOLVED: That planning application K.16430 – 41 Milvil Road, Lee-on-the-Solent be approved subject to the conditions set out in the report of the Regulatory Services Manager.

Members were advised that lines three and four of paragraph 1.2 of the report should contain the words "two one-bedroomed" in place of "two two-bedroomed".

Members expressed concern that this proposal would result in a loss of green space but accepted that outline planning permission had been granted on the land.

114. UPDATES ON APPEALS
Officers updated Members on an appeal relating to 14 Grove Road, Gosport, which the Council had lost and a discussion ensued on the decision of the Inspector and the factors relating to it.
Members were advised that that a future training for Regulatory Board Members would be held, which would make use of case studies on previous Board decisions.
