1. I have to report that, whereas the number of Candidates validly nominated in the election of Councillors for each of the Alverstoke, Anglesey, Bridgemary South, Bridgemary North, Brockhurst, Christchurch, Elson, Forton, Grange, Hardway, Lee East, Lee West, Leesland, Peel Common, Privett and Rowner and Holbrook Wards of the Borough exceeded the number of Councillors to be elected for the respective Wards, a poll was taken on the 2nd day of May 2002, and the votes cast for the respective Candidates at each such election were as follows:-

AMENDMENT TO THE COUNCIL'S CONSTITUTION
Consideration was given to a report of the Chief Executive setting out amendments to the Council's Constitution.
It was reported that, at its meeting on 11 April 2002, the Council confirmed that there would be eight Members of the new Conduct and Standards Committee, two of whom were independent members. Unfortunately, neither that figure nor the quorum for the Committee were inserted within the Standing Orders for the Conduct of Council Business. Statutory guidance would indicate, as in accordance with Chapter 8 of the Constitution in Part 2, that the quorum of a Conduct and Standards Committee of that size should be three members, again one of whom must be independent.
The basic procedures for the management of complaints by the Conduct and Standards Committee were contained in Part 4 - Schedule 17 to the Constitution. The meetings of the Committee would be run on the same style as the Boards and Sub-Boards of the Council. Accordingly it was intended that Part 6 of the Standing Orders for the Conduct of Council Business be amended.
It was also pointed out that at the top of Page 6 in the Protocol for Member/Officer relationships it should have read 'Financial Services Manager and Head of Accountancy' rather than 'Head of Finance'. In addition, there was an omission from the Constitution of the portfolio for Chairmen of the Boards other than the Regulatory Board, which was attached as an Appendix to the report.
The Chief Executive reported that it was intended that Standing Orders 6.0, 6.1 and 6.1.1 of the Standing Orders for the Conduct of Council Business read as follows -
"6.0 PROCEEDINGS AT BOARD, SUB-BOARD AND CONDUCT AND STANDARDS COMMITTEE MEETINGS
6.1(A) Definition
For the purposes of Standing Order 6, reference to Board and/or Sub-Board shall, except where otherwise provided, be deemed to include the Conduct and Standards Committee.
6.1 Quorum
6.1.1 A quorum for a meeting of a Board shall be four Members and for a meeting of a Sub-Board shall be two Members. The quorum for a meeting of the Conduct and Standards Committee shall be three members of the Committee, one of whom shall be an independent member of the Committee."
RESOLVED: That the amendments to the Constitution as set out above be approved.

MEMBERSHIP OF BOARDS SUB-BOARDS AND COMMITTEES
The Members of the Council had before them a report of the Chief Executive (a copy of which is attached hereto as Appendix "C1") in connection with the above.
The report advised the Council that it had to be aware of the main terms of the "Proportionality Rules" made under the Local Government and Housing Act 1989. The rules also provided that the Council should have regard to the wishes of Political Groups in the appointment of seats on Boards, Sub-Boards and Committees "allocated" to those Groups under the Rules.The Chief Executive reported that after the elections on 2 May, the balance of the seats on the Council between the Political Groups was as follows:

The Chief Executive advised that subject to proportionality rules the allocation of seats on each individual main Board/Overview and Scrutiny Committee must be made in accordance with the balance of seats on the Council. The following allocation gave effect to this criterion:

AMENDMENT: That the Liberal Democrat Group's allocation of seats on the main Boards viz. Policy & Organisation, Community & Environment, Housing and Regulatory be four members each.
The Amendment was put to the meeting and declared LOST.
The Original Motion was put to the meeting and duly RESOLVED.

their Chairmen, Vice-Chairmen, Sub-Committees, representatives to serve on other Committees and Outside Bodies.
It was moved and subsequently RESOLVED that the three Overview and Scrutiny Committees should also convene to select
their Chairmen and Vice-Chairmen. The three Overview and Scrutiny Committees duly met but failed to appoint Chairmen
and Vice-Chairmen.

At 7.47pm the Council adjourned for 10 minutes in order to consider the matter of appointing Chairmen and Vice-Chairmen to the Overview and Scrutiny Committees.

RESOLVED: That the Council's representatives on the Local Government Association for the ensuing Municipal Year be Councillors Cully, Edgar and Searle
(G) PORTCHESTER CREMATORIUM JOINT COMMITTEE
RESOLVED: That the Council's representatives on the Portchester Crematorium Joint Committee for the ensuing Municipal Year be Councillors Hook and Train with Councillor Langdon as Standing Deputy.
(H) AGE CONCERN (HANTS)
RESOLVED: That the Council's representative on Age Concern (Hants) for the ensuing Municipal Year be Councillor Mrs Cully.
(I) GOSPORT SOCIETY
RESOLVED: That the Council's representative on the Gosport Society for the ensuing Municipal Year be Councillor Redrup.
(J) CITIZENS ADVICE BUREAU
RESOLVED: That the Council's representative on the Citizens Advice Bureau until 31 March 2003 be The Mayor.
(K) ALVERSTOKE TRUST
RESOLVED: That the Council's representative up to September 2003, consequent upon the death of Mrs M Geall, be Retired Surgeon Captain Timothy Hall of 3 The Spur, Palmerston Way, Gosport.
(L) LUTMAN DAY CARE CENTRE SUPPORT GROUP
RESOLVED: That as no nomination was made to the Support Group the matter be deferred to the next meeting of the Council.
(M) PRIDDY'S HARD TRUSTEESHIP

RESOLVED: That the Council's representative on the Priddy's Hard Trusteeship for the ensuing Municipal Year be Councillor Langdon.
